G. A grading plan, soil borings, and the survey {"B" above) illustrating lot Iines and <br />house setbacks must be submitteci with the building perinit application. <br />H. Within thirty {30} days aiter approval by t�e City Council, the applicant sha�l <br />supply the final survey to the Corr�rriunity Development Director for review and <br />approval. A certificate of survey shall be required on all proposed parcels. After <br />catnp�etion af the review and approval by the Ci�y Manager, the survey s11a11 be <br />recorded by t�e applicant with the Ramsey County Recorder within sixty (60) <br />days. �'ailure to record the subdivision within sixty (60) days shalt nullify the <br />approval of the subdivisian. {Ord. 1171, 9-23-1996) <br />Member poherty asked for ciarification of the west property line and the adjoining house <br />and the drainage from south to narth on the site. (The laouse is set back appraxiznately 5 <br />feet). Deb Bloom explained tl�e drainage and grading. <br />Jon Forman explained that alternatives 2 and 3 would rec�uire r�c�aving the driveway and <br />repaving. He noted there is a po�ential buyer for each parcel. <br />C�air Traynor asked �aw the trees will be pareserved since Mr. Forman will simply sell <br />tl�e site but not dev�lop the �ew homes. Forman nated that many �ak� have been last to <br />aak wilt, Chair Traynor explained that there is no prohibition an an owner cutting trees <br />down on their own site, but tha� tree preservation could be a conditian of variance <br />approval. <br />Chair Traynor noted and accepted for the file a petitian �igned by neighbors opposing the <br />variance and an email from Vivian Ramalingam of Acorn Road, also opposed to the <br />project because of lass of trees, drainage and neighbor�aood annbience, and patlas and <br />parking along County Road B. <br />Mr. George Letendre, 2121 West County Road B, stated t�at the variance statute was not <br />met (und�e hardship, �zniqueness of the site, and altering the character o� t�� site). He <br />cited the Van Landershoot Case as a similar circuinstance. The applicant is selling the <br />site, there is na hardship. The neighborhoad is not about s�nall lots — t�e average is <br />approximately 20,D00 s.f. Chair Traynor asked if Fortnan used no variance and still could <br />subdivide — would this �e preferable? Letendre said he feIt these alternatives wauld not <br />take pIace because oithe cast to do ihem, but would be opposed because of drainage and <br />lot coverage. <br />Joel Cheney, 2172 Acorn Road, suggesied a 2 lot subdivision. <br />There bein�; no further camment, Chair Traynor clased the hearing. <br />Chair Traynor expressed concert� about the impac� on the site, neighbarhood and Acorn <br />Roaci and ha� reservatians on the variances.
