Liquor Citation Issues on April 10 agenda <br />Page 2 o f 2 <br />I asked Jay Squiers for an update on the criminal complaint re: the liquor citation appeals. He says that the <br />Maple Grove city attorney has decided not to move forward with the complaint, and that it is now appropriate <br />for the council to take up these issues again. Since Jay indicates that neither he nor Scott Anderson will be <br />available for the March 27 meeting, I request that this be added as an item on our April 10 agenda. At a <br />minimum 1 would like to take up the questions I raised in my memo of January 23 (attached and pasted below) <br />-- and will subt�i� any addtional questions to the city attorney in advance of the April 10 meeting. <br />Thanks, <br />r��i7w <br />Liquor Citation Appeals <br />I would like to request the following information, and request that this liquor appeals issue be put on the <br />agenda again at a future meeting after the information is available: <br />1. Could the council please have a copy of the form letter sent to licensees informing them of their right to <br />appeal to the city manager? <br />2. What authority is there in city ordinances for appealing liquor citations to the city manager? <br />3. I f the answer to this question is "none", the council should schedule public hearings on the penalties <br />under 3a2.15(C}. <br />4. 1 wouid like to request legal analysis as to whether the council has to allow any right of appeal from a <br />liquor citation (other than whatever rights licensees would have to go to court). Are we required to hold a <br />public hearing to suspend a license temporarily? <br />5. I f the council thinks these penalties should be "presumed appropriate for every case" as indicated in <br />3d2.15(B}, why not take them seriously and enforce them? I wouid support amending our ordinances to limit or <br />remove the right of appeal altogether. 1 do not support delegating discretion on [iquor citation penalties to the <br />city manager. <br />�Ja.��{1fi <br />
