Agenda Section: <br />NB/DM/RT �,�� <br />Ttcz�n Description: Proposed City Code Revisions regarding public nuisance abatement <br />�xr��� dure� <br />..—� <br />],�i TOPIC DISCRIPTION: <br />E, F Council discussion and direction is requested regarding proposed changes to public <br />nuisance abatement procedures that will allow staff to more quickly abate the specific <br />public nuisance violations of graffiti and dead vegetative matter, and, to change the <br />number of required council public hearings necessary to approve an abatement from two <br />hearings to one. <br />�.,� BACKGROUND: <br />�_ ] City Code Section 407.06 (POWERS OF OFFICERS) addresses procedures for the <br />abatement of puhlic nuisance violations listed in Section 407.0�, q2 and 03. City Council <br />approval is required prior to abatements oecuxring. <br />a. City Code Section 407.08 (ACCELLERATEDABATEMENTPROCESS FOR <br />CERTAJN NUISANCES) allows for the accelerated abatement of specific public <br />nuisance violations (tall grass over $", nuisance weeds, other vegetative growth, <br />and, snow and ice removal). <br />b. Staff is recommending that Graffiti and vegetative debris be added to the list of <br />public nuisances that can. be addressed under the accelerated abatement process. <br />Crraff� is a puhlic nuisance that tends to draw more of the same and depresses <br />surroundingproperty values. Also, it is difficult to obtain compliance quickly; <br />often staff is dealing with absentee building owners who are difficult to contact, <br />and, sometimes it is sprayed on dumpsters and is not removed because the <br />building owners do not own the dumpsters. Vegetative debris piles ofien harbor <br />rodents and also depress properiy values. Obtaining compliance quickly is <br />difficult because of the time involved in the existing abatement process (assuming <br />the properiy owner is not cooperative); by the time staff can obtain approval from <br />City Council, the growing season is over and the vegetation ofien covered with <br />snow — and the neighbors have lived next to the puhlic nuisance for months. <br />c. With graffiti andvegetative debris included in thosepublic nuisanceviolations <br />that can be addressed under the accelerated abatement process (407.08) property <br />values will not be adversely affected and the livability of neighborhoods will be <br />maintained <br />RCA�AccelA.bfnxf�'�°oc05030G (2).doc Page � of 3 <br />
