City Council Regular Meeting— 08/14/06 <br />DRAFT Minutes - Page 22 <br />Interim City Manager Miller reviewed the proposed interview <br />schedule for vacancies in the Planning Commission and <br />reinstatement of the Ethics Commission; and the proposal for <br />scheduling a Special Council meeting on August 21, 2006 for the <br />purpose of interviews. <br />Discussion ensued related to which, or all, candidates to be <br />interviewed, with Council consensus being that all candidates <br />should be interviewed to ensure public perception of an open- <br />minded process from the candidate's perspective; recognition of <br />the extensive time commitment of candidates and <br />Councilmembers; and need "to schedule two meetings for <br />purposes of scheduling and work concerns. <br />After further discussion, staff was directed to schedule the <br />Planning Commission interviews on August 21,2006 prior to the <br />City Council Study Session; and the Ethics Commission <br />interviews on August 28, 2006 prior to the regular City Council <br />meeting; with staff directed to set the start time according to the <br />number of candidates to be interviewed and their availability. <br />10. Authorize the City Attorney to Select an Independent <br />Hearing Officer to Consider Alcohol Compliance Penalties <br />Interim City Manager Miller reviewed the background of the <br />request for the City Council to authorize the City Attorney to <br />select an independent hearing officer and to schedule hearing <br />dates for the C�reen Mill and Old Chicago restaurants related to <br />alcohol compliance penalties. <br />City Attorney Scott Anderson sought hearing officer <br />appointment preference from Councilmembers, in accordance <br />with Sections 14.57 — 14.69 of the State's Administrative <br />Procedure Act and State Statute 340A.415, a license holder has <br />the opportunity to request a hearing on the proposed penalty <br />and/or suspension. <br />Councilmember Pust opined her support of using the Office of <br />Administrative Hearings (OAH); and if not using them that the <br />hourly rate of the proposed independent hearing officer not <br />exceed that of their hearing officers. <br />Planning and <br />Ethics <br />Commissions <br />City Attorney to <br />Select an <br />Independent <br />Hearing Officer to <br />Consider Alcohol <br />Compliance <br />Penalties <br />
