City Council Regular Meeting— 08/14/06 <br />DRAFT Minutes - Page 23 <br />Discussion ensued regarding use of the ALG; hourly rates; <br />qualifications and expertise of arbitrators; and the process. <br />Kough moved, Ihlan seconded, authorizing the City Attorney to <br />select an independent hearing officer, selected from the Office of <br />Administrative Hearings (OAH) personnel, to consider alcohol <br />compliance penalties imposed on the Green Mill and Old <br />Chicago restaurants. <br />Roll Call <br />Ayes: Ihlan; Pust; Kough; and Klausing. <br />Nays: Maschka. <br />11. Councilmember-Initiated Items from July 24, 2006 Council <br />Meeting — or past meetings <br />1�..a Request of Councilmember Ihlan: City practices and <br />policy for forwarding e-mails to third parties; and <br />who determines the relevance of when information is <br />included in a Council packet <br />Interim City Manager Miller reviewed City Attorney- <br />recommended language to accompany the e-mail <br />hyperlink located on the City's website, linking to City <br />Councilmember's e-mail boxes. <br />Discussion included determination of who on City staff <br />were included as recipients of e-mails addressed to the <br />Council as a whole; Councilmember Ihlan's interpretation <br />of State Statute 13.601 language related to elected <br />officials and staff; ability of senders to address their <br />concerns privately to individual Councilmembers; and <br />City Attorney interpretation and legal advice to the City <br />Council related to proposed language and recipient <br />identity. <br />Councilmember Ihlan disputed City Attorney Anderson's <br />interpretation of State Statute; and opined that "we'll be <br />government by City Attorney." <br />Councilmember Pust opined she would rely on the advice <br />Councilmember- <br />Initiated Items <br />from past meetings <br />Forwarding <br />e-mails to third <br />parties; and <br />information <br />included in a <br />Council packet <br />
