of the curb edge of County Road C and the permanent easement is 22 feet in width, <br />extending north of the existing property line. This places the property line for setback <br />purposes 37 feet north oi th� curb edge of County Road C(see attached colored site <br />plan). <br />��.? Based on the information provided by Ramsey County the setback from the permanent <br />roadway easement line lies 15 feet within the existing parking lot, rendering this portion <br />un-useable unless a VARIANCE is granted. On October 14, a VARIANCE approved by <br />the Variance board on October 4, became effective. <br />.�_� SUGGESTED CITY COUNCIL ACTION: <br />��, : Since the applicant has received VARIANCE approval to utilize a portion of the <br />premises parking lot, a previously requested CONDITIUONAL USE PERMIT can <br />now be acted upon. <br />:��,� ADOPT a RESOLUTION APPROVING a CONDITIONAL USE PERMIT for <br />Cummings Mobility allowing a"motor vehicle dealer" at 1755 County Road C based on <br />the findings of Section 6 and the following conditions: <br />1. The site and this applicantluse (Cummings Mobility) shall be limited to a front <br />yard vehicle sales/display area not exceeding 10 vehicles. <br />2. The applicant shall provide parking lot striping to accommodate parking and <br />drive lanes to achieve adequate traffic flow as prescribed by the City Engineer <br />and Planner and consistent with the aerial photo and site plan dated October 4, <br />2006. <br />3. Applicant shall work with staff lo apply appropriate landscape to soften the <br />frontage along County Road C in keeping with improved aesthetics of the <br />roadway. <br />4. No vehicles requiring work shall be located in the front yard. These vehicles are <br />required to be stored inside, in the fenced security area, or the rear of the <br />structure. <br />5.
