or redevelopment by a tlurd party within the Redevelopment Area, condemn or agree to proceed with <br />the condenmation of any property within the Redevelopment Area to assist or facilitate development <br />within such area by any third party. The City acknowledges that Redeveloper has, during the term <br />of this Agreement, the exclusive right to deal with the City on matters relating to the redevelopment <br />of the Redevelopment Area, and the City will do nothing which is inconsistent with that right. <br />Redeveloper understands, however, that much of the real property in the Redevelopment Area is <br />owned by third parties and that the City cannot preclude the development thereof by its owners; <br />provided, however, the City agrees to consider implementing an interim ordinance pursuant to <br />Minnesota Statutes 462.355 as necessary far the protection of the planning phases of the <br />Redevelopment Area, and p,-ovided fi�rther that the City reserves the right to seek the Redeveloper's <br />written consent to modifications or exclusions from this paragraph on a case-by-case basis, which <br />the Redeveloper agrees to consider a��d determine in its reasonable discretion and within a reasonable <br />timeframe, and to inform the City of its decision promptly in writing. <br />(b� The City agrees to promptly process all applications relating to the <br />Redevelopment. 'I'he City shall take reasonable steps consistent with its statutory autharity and <br />legislative discretion, where applicable, to initiate and complete or cause to have completed on a <br />timcly basis all necessary and appropriate governmental actions needed to redevelop the <br />Redevelopment Area, including, but not limited to, those actions set forth in Section 11. <br />6. Phased Development. <br />(a) Redeveloper and the City acknowledge that the Redevelopment Area may be <br />redeveloped in non-contiguous phases over a number of years. The redevelopment of the <br />Redevelopment Area, including the scope, nature and location of phased redevelopment, will be <br />subject to such priorities as Redeveloper and the City, in their reasonable judgment, deem consistent <br />with the Master Plan and market conditions, taking into consideration the following variables: <br />timing, geographic areas within the Redevelopment Area; the scope of necessary improvements; and <br />the type of development to take place (far example, residential or commercial). <br />(b) As a result of the phased redevelopment of the Redevelopment Area, the City <br />anticipates that it will enter into a Redevelopment Agreement for the Redevelopment Area with <br />Redeveloper which may provide for separate Redevelopment Agreements with Redeveloper for <br />certain phases of redevelopment of the Redevelopment Area. The terms and conditions of such <br />Redevelopment Agreements shall be subject to the provisions of this Agreement and the mutual <br />agreement of Redeveloper and the City. <br />7. Redeveloper Actions. Redeveloper shall take the following actions: <br />(a) By September 30,2004: <br />� Complete work with an Advisory Stakeholder Task Farce to be <br />appointed by the Council (to include property owners, residents, <br />neighbarhood groups, business owners and developers) in formulating <br />the Implementation Plan. <br />e <br />
