3.0 PUD APPROVAL : <br />The CITY hereby grants approval of the Planned Unit Development (identified as <br />Exhibits A through K in Section 4 of this Agreement), subj ect to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits, if said applications are consistent with the plans <br />identified in Section 4.0 below. <br />For any improvements not contemplated in this Agreement, the CITY may require <br />compliance with any amendments to the Comprehensive Guide Plan, official controls, <br />platting or dedication requirements enacted after the date of this Agreement. <br />4.0 APPROVAL by the CTTY: <br />The CITY hereby approves the following plans on file with the City. The DEVELOPER <br />shall develop the subject property in accordance with these plans. If, however, the plans <br />are inconsistent with the written terms of this Agreement, the written terms of this <br />Agreement shall control. If the plans address items not specifically addressed in this <br />Agreement, the plans shall govern with respect to those items. The plans are: <br />Exhibit A Existing Site Conditions Survey that indicates all conditions on the two <br />parcels including buildings and contours, dated August 10,2004. <br />Exhibit B Greenhouse Village subdivision plat indicating Lot 1, Block 1 for the <br />senior cooperative and Lot 2, Block 1 for the future town home phase, <br />datedNovember 11,2004 <br />Exhibit C Site Development Plan that includes property boundary, building <br />setbacks, structure location (including the trash enclosure), curbing, and <br />parking setbacks (Drawing No. C-4), dated August 4,2004. <br />Exhibit D Grading Plan illustrating existing grades and those proposed after <br />completion of the proposed construction, drainage directions, spot <br />elevations, catch basins for surface water catchment, and the erosion <br />control plan (Drawing No. C-5), dated August 10,2004. <br />Exhibit E Utility Plan including sanitary sewer, watermain, and storm sewer and <br />illustrating all connections, pipe sized, line locations, manhole locations, <br />hydrant locations, and other applicable utility plan information (Drawing <br />No. G6), dated August 10,2004. <br />Exhibit F Landscape Plan including materials list, sizes, and locations of all plant <br />materials (Drawing No. L1 and installation and 10 to 12 year growth <br />perspectives), dated August 10,2004. <br />� <br />
