6.0 DEVELOPMENT of PROPERTY: Failure by the DEVELOPER to commence and diligently undertake development activity in accordance with the final developmentplans within two years of the effective date of this Planned Unit Development will necessitate the DEVELOPER seeking approval of an extension of the development schedule by the City Council within 60 days after the conclusion of the two year period. If an extension is not applied for, the Council may instruct the Planning Commission to initiate rezoning to the original B-1 and R-1 zoning districts or to a zoning designation consistent with the Comprehensive Plan. For purposes of this provision, development activity shall be defined as obtaining a building permit, commencing and continuing with project construction on the site. Development of the property and installation of improvements shall be in substantial accordance with the anticipated development schedule provided by the DEVELOPER and approved by the CITY (Exhibit I). 7.0 COMPLIANCE with LAWS and REGULATIONS: The DEVELOPER represents to the CITY that, to the best of its knowledge, any site improvements pursuant to the proposed development will comply with all City, County, Watershed, Regional, Metropolitan, State, and Federal laws and regulations, including but not limited to the Roseville Subdivision Regulations, the Roseville Zoning Regulations, and all other applicable environmental regulations. 8.0 SITE DEVELOPMENT REQUIREMENTS: To ensure that the proposed developmentmeets the CITY'S requirements and standards for site development, the following provisions shall apply: �k. � Final Grading Plan. The final grading plan for each property and/or site must be reviewed and approved by the Director of Public Works before any permits will be issued. All grading shall comply with the approved grading plans and shall be the responsibility of the DEVELOPER The DEVELOPER's engineer shall provide to the CITY a letter certifying that the grading proj ect was constructed and was completed as depicted in the approved grading plan (Exhibit D) prior to the issuance of a Certificate of Occupancy. !k. �� Final Utility Servicing Plan. The final utility servicing plan for each property and/or site must be reviewed and approved by the Director of Public Works prior to any permits being issued for the building (Exhibit E). 8.3 Erosion Contro� Prior to site grading, and before any utility construction is commenced or building permits are issued, an erosion control plan must be submitted for approval by the Director of Public Works and/or the Rice Creek Watershed, and all erosion control actions shall be implemented, inspected and approved by the CITY (Exhibit D). 4
