� <br />Property as identified on the attached site plan from Cleveland <br />Avenue to Fairview Avenue. <br />All public streets and traffic signals throughout the Development <br />Property must be constructed by the Redeveloper to City approved <br />standards. Fire hydrants must be installed on all public streets and <br />easements after approval by the Fire Marshal. The public streets <br />will be platted and will only become City Streets upon completion <br />and acceptance by the City. The City will maintain all public <br />streets as part of their street system which includes street <br />sweeping, snow plowing and regular maintenance <br />The plans for the public streets will be as prepared by RLK and <br />submitted to the City for City approval. <br />The City will consider an assessment of the cost of construction of <br />public streets and traffic signals upon the request of the <br />Redeveloper. The City will only assess the streets upon the <br />Redeveloper's petition and waiver of public hearing and agreement <br />to accept 100 percent of the assessment cost based upon the City <br />Assessment Policy. The term and interest rate for such assessment <br />will be determined by the City Council. <br />The City will provide any "net balance" for existing road vacations <br />as a credit to the cost of the construction of new public streets. <br />The value of the vacations will be determined and agreed upon by <br />the Redeveloper and the City. A credit for a"net balance" will be <br />available to the City only to the extent that the area of land <br />provided by the City upon the vacation of any streets, roads or <br />alleys is in excess of the area of any dedicated streets and roads <br />located in the Final Plat. <br />Utilities: Utility connection frozn public easements or right of way to each <br />building is the responsibility of the Redeveloper. Metropolitan <br />Council Sewer Access Connection (SAC) fees for utility <br />connections are to be paid by the Redeveloper. The Redeveloper is <br />responsible for compiling an inventory of all existing SAC credits. <br />The City is willing to pursue, at the Redeveloper's request, a <br />waiver of SAC fees by the Metropolitan Council based upon the <br />availability and adequate funding of the inclusionary housing <br />program. <br />Lighting: The Redeveloper is responsible for working with Xcel Energy and <br />installing decorative street lighting on all public streets within the <br />Development Property. All lighting for commercial uses must <br />generally conform to the Twin Lakes Design Principles and <br />County Road C Master Plan and be downcast and noninvasive, <br />� <br />
