Bloomington City Code Chapter 3 page 1 <br />Section 3.04. ORDINANCES, RESOLUTIONS AND <br />MOTIONS. <br />All legislation must be by ordinance, unless otherwise stated in this <br />charter. The votes on ordinances, resolutions, and motions must be recorded <br />unless the vote is unanimous, in which case the vote must be recorded as <br />being unanimous. An affirmative vote of a majority of all councilmembers is <br />required for the passage of ordinances and resolutions, unless otherwise <br />provided by this charter. <br />(Section 3.04 amended by Ord. No. 2004-8, 4-5-2004) <br />Section 3.05. PROCEDURE ON ORDINANCES. <br />A statement of the purpose and effect of every ordinance, except an <br />emergency ordinance, stating the time and place atwhich itwill be <br />considered, must be published once in the official newspaper at least one <br />week before its introduction and final passage. <br />(Section 3.05 amended by Ord. No. 2004-8, 4-5-2004) <br />Section 3.06. EMERGENCY ORDINANCES. <br />An emergency ordinance is an ordinance necessary for the immediate <br />preservation of the public peace, health, morals, safety or welfare of the city. <br />The emergency must be defined and declared in its preamble and must be <br />adopted by a vote of at least five members of the council. No prosecution can <br />be based upon the provisions of an emergency ordinance until 24 hours after <br />the ordinance has been filed with the council secretary and posted in a <br />conspicuous place at the city hall or until the ordinance has been published, <br />unless the person charged with a violation had actual notice of the passage of <br />the ordinance before the violation. <br />(Section 3.06 amended by Ord. No. 2004-8, 4-5-2004) <br />Section 3.07. PROCEDURE ON RESOLUTIONS, <br />Every resolution must be presented in writing <br />(Section 3.07 amended by Ord. No. 2003-6, 3-3-2003; Ord. No. 2D04-8, 4-5- <br />2004) <br />Section 3.08. SIGNING AND PUBLICATION OF <br />ORDINANCES AND RESOLUTIONS. <br />Every ordinance or resolution passed by the council must be signed by <br />the mayor or by the acting mayor, attested by the secretary of the council and <br />filed and preserved by the secretary. Every ordinance and any resolutions <br />requested by the mayor or by two other members of the council must be <br />published at least once in the official newspaper.
