or redevelopment by a third partywithin the Redevelopment Area, condemn or agree to proceed with <br />the conden��aat�o�. of any property v�itt�in the RedevelopmentArea to assist or facilitate development <br />within such area by any third paz-ty. The City acknowledges that Redeveloper has, during the �erxn <br />of this Ag�eement, the exclusive right to deal with the City on matters relating to the redevelopment <br />of the Redevelopment Area, and the City wi11 do nothing which is inconsistent with that right. <br />Redeveloper understands, however, that much of the real property in the Redevelopment Area is <br />owned by third parties and ��at the City cannot preclude the development thereof by its owners; <br />piovided, however, the City agrees to consider implementing an interim ordinance pursuant to <br />Minnesota Statutes 462.355 as necessary for the protection of the planning phases of the <br />Redevelopment Area, and provicled furtlaer that the City reserves the right to seek the Redeveloper's <br />written consent to modi�ications or exclusions from this paragraph on a case-by-case basis, which <br />the Redeveloper agrees to consider and detern�in� in its reasonable discretion and within a reasonable <br />titne#'i-ame, and to x�fQZ�z� the City of its decision promptly in writing. <br />�b� The City agrees to promptly process a11 applications relating to t1�e <br />Redevelopment. The City sha11 take reasonable steps consistent with its statutory authority and <br />legislative discretion, where applicable, to initiate and complete or cause to have completed on a <br />timely basis a11 necessary and appropriate go�ernmentai actions needed to redevelop the <br />R�c�evelopi��ei�t Area, inch3diz��, but not limited to, those actions set forth in Section 11. <br />6. Phased Develo�ment. <br />(a) Redeveloper and the City acknowledge ti�at the Redevelopment Area may be <br />redeveloped in non-contiguous phases over a number of years. The redevelopment of the <br />Rede�eio�rr�e�7t Area, including the scope, nature and iocatiioz� of phased redevelopment, wi11 be <br />subject to such priorities as Redeveloper and ihe City, in their reasonable judgment, deem consistent <br />with the Master k'Iat� and market conditions, taking into consideration the following variables: <br />itnZin�, geographic areas within �l�e RedevelopmentArea; the scope of necessaryimprovements; and <br />the type of development to talce place (for example, residential or commercial). <br />�b� As a result of the phased redevelopment of the Redevelopment Area, the City <br />arzticzpates that it wi11 enter u�ta a Redevelopment Agx-eement for the Redevelopment Area with <br />Redeveloper which may provide for separate Redevelopment Agreements with Redeveloper for <br />ce�tain phases of redevelopment of the Redevelopment Area. The tenns and conditions of such <br />Redevelopmer�t A�eements sha11 be subject to the provisions of this Agreement and the mutual <br />agreement of Redeveloper and the City. <br />Red�veJo�er Actions.
