a) Costs associated with the public street reconstruction between stations <br />15�50 and i9-�00 (350 feet) shall be shared between the CITY and the <br />DEVELOPER. The cost split for the street construction costs for this <br />segment shall be 75% CITY and 25% DEVELOPER. The CITY's cost <br />shall be $33,763.17 and the DEVELOPER shall be $11,254.4Q, The <br />estimated cost is $45,017.57. <br />b) Costs associated with the public street reconstruction between stations <br />� 9�Q� and 21+50 shall be the sole responsibility of the DEVELOPER. <br />The estimated cost is $32,598.93. <br />c) Costs associated with sidewalk construction required as part of the <br />development shall be the sole responsibility of the DEVELOPER. See <br />subsection 2C below for discussion of non- vehicular transportation <br />corridors. <br />d) DEVELOPER shall promptly begin the work, and shall complete the <br />work, subject to force majeure, on or before October 1,2005. <br />e) DEVELOPER shall assure that all its contractors are insured at least in the <br />limits provided by Minn. Stat. Ch. 466. <br />In the event unforeseen conditions occur which may impact the cost of the <br />Frontage Road reconshuction, DEVELOPER shall notify the City and <br />provide for an opportunity for input. <br />g) DEVELOPER shall cause its contractor(s} to segregate the cost of the <br />Frontage Road reconstruction for purposes of the cost-sharing provided <br />herein. <br />h) DEVELOPER shall promptly pay its contractors for the Frontage Road <br />reconstruction. <br />i) Upon completion of the work, submission of evidence of payment of <br />contractors, and a satisfactory inspection by the City Engineer, the City <br />shall reimburse DEVELOPER for its share of the Frontage Road <br />reconstruction work. <br />• County Road B median and intersection work DEVELOPER intends to <br />perform certain work within the County Road B right-of-way, and has obtained <br />or will obtain the approval of Ramsey County necessary to undertake the work. <br />The work shall be undertaken consistent with the County's approval, and shall <br />be undertaken in a fashion not inconsistent with the terms of this Contract and <br />at the sole cost of DEVELOPER. The estimated cost of this portion of the <br />public improvements is $136,813. The cost for this improvement shall be the <br />DEVELOPER's sole responsibility. <br />
