CITY of ROSEVILLE <br />PLANNED UNIT DEVELOPMENT AGREEMENT # <br />This PLANNED UNIT DEVELOPMENT AGREEMENT, dated Apri111,2005 is entered <br />into between the City of Roseville, a Minnesota municipal corporation, of 2660 Civic Center <br />Drive, Roseville, Minnesota 55113 ("CTI'Y") and Rosedale Shopping Center by Jones, Lang, <br />�aSal�e Properties, 1595 Highway 36 West, with offices at 10 �oseciale Center Roseville, MN <br />55113 ("DEVELOPER"). For reference, the parcel number is: 0929234i0004 ana tne City of <br />Roseville proj ect file is: PF3G08. <br />1.0 EFFECTIVE DATE of AGREEMENT: <br />This agreement shall be effective upon completion of all of the following: <br />1.1 Passage and recording of this PUD document, amending the existing Rosedale <br />Shopping Center PUD of January l, 2000 (Ordinance # 1234}, with specific terms <br />and conditions for redevelopmentlexpansion of the Mall. <br />1.2 Execution of this agreement by the CITY and the DEVELOPER. <br />13 Recording of the Public Improvements Contract, the amendments to the Transit <br />Hub and Transit Operating Agreements and any City approved public easements, <br />with Rar�asey County Recorder. <br />2.0 REQUEST for PUD APPROVAL: <br />The DEVELOPER has requested that the CITY approve an amendment to portions of <br />the existing Roseda�e Shopping Center Planned Unit Development (PUD) of January 1, <br />2000 (Exhibit A) that provides for the removal of the three story 170,000 sq. ft. east <br />wing anchor department store (formerly known as Mervyn's} and redevelopment of <br />appro�mately 182,386 sq. ft. of retail space in a three story format, which includes <br />123,708 sq. ft. of retail space and a 58,678 sq. ft. 14 screen movie theater on 14.97 <br />acres wherein the building footprint area expands by 12,386 sq. ft., located at 1595 <br />Highway 3 6 West. <br />The legal description for this development is: <br />Rosedal� Center Fourth Addition Lots 3& Lot 4, Block 1 <br />3.0 PUD APPROVAL: <br />The CITY hereby grants approval of the amended Planned Unit Development (identified <br />as Exhibits A through N in Section 4 of this Agreement), subject to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits, if said applications are consistent with the plans <br />identified in Section 4.0 below. <br />
