For any improvements not contemplated in this Agreement, the CITY may require
<br />compliance with any amendments to the Comprehensive Guide Plan, official controls:
<br />platting or dedication requirements enacted af�er the date of this Agreement.
<br />4.0 APPROVAL by the CITY:
<br />The CITY hereby approves the following plans on file with the City. The DEVELOPER
<br />shall develop the subject property in accordance with these plans. If, however, the plans
<br />are inconsistent with the written terms of this Agreement, the written terms of this
<br />Agreement shall control. If the plans address items not specifically addressed in this
<br />Agreement, the plans shall govern with respect to those items. The plans are:
<br />Exhibit A E�sting Land Use, Zoning and Site Conditions Surveys that indicates all
<br />conditions on the parcels including buildings and contours, dated 7anuary
<br />1,2000, and ,2005.
<br />Exhibit B Amended Transit Hub and Transit Operating Agreements
<br />2005, and Transit Hub Site Plan illustrating addenda (as summarized in
<br />the letter of intent dated ) for transit hub improvements
<br />including bus routes, rider waiting and driver and customer rest areas,
<br />hub shelter, bus waiting areas; park and ride lot, shelter, and parking,
<br />dated ,2005
<br />— Exhibit C Site Development Plan that includes properry boundary, building
<br />_ setbacks, structure location (including the trash enclosure), curbing,
<br />parking, parking setbacks, and proof of parking (Drawing No. C-2), dated
<br />— March 31,2005.
<br />Exhibit D Grading and �'anding/Storage Plan illustrating existing grades and those
<br />proposed after completion of the proposed construction, drainage
<br />directions, spot elevations, catch basins for surface water catchment,
<br />ponds and storage basis (at and below surface) and the erosion control
<br />plan (Drawing No. C-3), dated March 8,2005.
<br />Exhibit E Utility Plan including sanitary sewer, water mains and hydrants, and
<br />storm sewer and illustrating all connections, pipe sized, line locations,
<br />manhole locations, hydrant locations, and other applicable utility plan
