City Council Regular Meeting — 04/11/OS <br />DRAFT Minutes ' Page 15 <br />was to correct existing City ordinance for consistency. <br />Connie Berry; President and CEO ofT'rans��p <br />Ms. Berry had e-mailed Councilmembers requesting three <br />considerations related to tonight's action that had not been <br />agreed-upon during negotiations between the staff and company. <br />Those items included a more lenient time frame for snow <br />removal (from 12 hours as stated to 24 or 48 hours); removal of a <br />shelter due to excessive vandalism; and moving of a shelter to <br />facilitate temporary construction and the expense of relocation or <br />removal and responsible parties. Ms. Berry noted that the <br />detailed requests were consistent with ordinances the firm <br />operated under in Minneapolis and St. Paul, and they were <br />seeking similar concessions in Roseville for consistency in their <br />operations and among the communities they serviced. <br />Discussion included snow removal clause language and time <br />allotment; public service announcements and use by the City for <br />such announcements; cleanliness of shelters; the good faith <br />competition to provide shelters; impact of proposed reductions <br />and/or eliminations of bus routes within the community; <br />coexistence and mutual location with U`.S. Bench at some <br />locations; and the willingness of the firm to go forward without <br />concession of the three requested revisions. <br />Mr. Schwartz provided the staff s perspective and advice <br />received from the City Attorney for retaining the recommended <br />language and conditions of the ordinance. Mr. Schwartz noted <br />that the snow removal clause was consistent with those <br />requirements for Roseville commercial properties for snow <br />removal from paths and sid�walks and was recommended for <br />consistency for transit riders; existing language covering <br />excessive vandalism and staff s willingness to work with <br />Transtop in relocation of shelters; and the City Attorney's <br />recommendation regarding relocation expense to private business <br />in the temporary relocation of shelters to accommodate <br />development. <br />Graduated Fee based on Gross Advertising Revenue <br />Maschka moved, Schroeder seconded, enactment of Ordinance <br />No. 1317 entitled, "An Ordinance Granting to Transtop <br />Ordinance 1318 <br />Amending Chapter <br />1207 <br />
