City Council Regular Meeting — 06/13/OS <br />DRAFT Minutes - Page 17 <br />case, upon the development's approval. <br />Councilmember Maschka questioned how payments in this <br />particular case were proposed to be handled. <br />Mr. Welsch advised that the Development Agreement would <br />stipulate costs to be borne by the developer at a date-specific <br />time. Mr. Welsch noted that the difference with this case was <br />that the City had chosen to work exclusively with one developer <br />for thc process of joint planning and development of a Master <br />Plan to end up with a development program for the entire site. <br />Councilmember Ihlan opined that the City Council needed to <br />enforce their own policy and should not expose the City and <br />individual Councilmembers to potential liability. <br />Councilmember Maschka sought City Attorney opinion as to <br />whether the City Council could be individually liable as <br />suggested by Councilmember Ihlan. <br />City Attorney Scott Anderson, at the request of Mayor Klausing, <br />opined that the City Council would not be exposing themselves <br />to individual litigation. <br />Mayor Klausing spoke against the motion, for similar reasons as <br />stated during discussion of the previous motion. <br />Roll Call <br />Ayes: Kough and Ihlan. <br />Nays: Maschka and Klausing <br />Motion failed. <br />13. Consider Motion to Delay Further Action on the Twin Lakes <br />Redevelopment Proj ect <br />Mayor Klausing requested City Manager Beets' interpretation of <br />the upcoming June 20,2005 Council agenda for content. <br />City Manager Beets reviewed the agenda topics. <br />Councilmember Kough expressed concern regarding the pending <br />Friends of Twin Lakes vs. City of Roseville litigation and <br />Consider Motion to <br />Delay Further <br />Action on the Twin <br />Lakes <br />Redevelopment <br />Project <br />
