P.U.D. Approval. The CITY has approved the Planned Unit Development in an <br />agreement dated May 9,2005 (the "PUD Agreement"). The land which is the subject of <br />this Agreement is legally described as follows: <br />Lot 4, Block 1, �.o�ed�Ie Center Fourth Addition <br />(Torrens Property — Certificate of Title No. 375111) <br />Lot 3, Block 1, Rasedale Center Fourth Addition, except that part of overlying Lots <br />6 and Lot 7, Block 5, Leinen Heights Number 2 <br />(Torrens Property — Certificate of Title No. 375111) <br />That part of Lot 3, Block l, Roseda�e Center Fourth Addition, that overlays Lot 6 <br />and Lot 7, Block 5, Leinen Heights Number 2 <br />(Abstract Property) <br />2. Conditions of Approval. <br />A County Road B-2 road improvements: The DEVELOPER hired a traffic <br />consultant to conduct a detailed traffic analysis based on the approximately <br />182,000 square foot Mervyn's reptacement/ expansion, which analysis <br />indicated tk�afi the following improvements and modifications are necessary at <br />an estimated cost to the DEVELOPER of $293,000: <br />1.
