City Council Study Session — 08/15/OS <br />DRAFT Minutes - Page 18 <br />Chris Miller address Councilmember Ihlan's concerns; opining <br />that the item would not impact the budget. <br />Finance Director Miller concurred that there was no budget <br />shortfall created; only a shift in the burden of who pays for the <br />HSS. <br />Mayor Klausing expressed concern that the Council was <br />rehashing the same arguments and having the same discussions <br />held consistently over the last year; and suggested a specific <br />action request from Councilmember Ihlan. <br />Further discussion ensued, with Mayor Klausing concluding that <br />Councilmember Ihlan had raised her issues; and there would be <br />no need for additional debate. <br />Adjaurnmemt/Reconvening <br />Mayor Klausing initially adjourned the meeting at 9:09 p.m.; and <br />due to several non-agenda items needing discussion, reconvened <br />the meeting at 9:10 p.m. at the request of Councilmembers <br />Kough and Maschka. <br />Non-A�enda Item <br />Friends of Twin Lakes v. City of Rasevil�e Litigation Update <br />Mayor Klausing and City Attorney Jay Squires reviewed the <br />summary court judgment handed down earlier today related to <br />two of the counts charged. <br />Mayor Klausing noted that the counts were related to 1) if further <br />environmental study was necessary; and 2) whether the City <br />Council was required to amend the Comprehensive Plan. Mayor <br />Klausing noted that the court had concluded for the City, through <br />summary judgment, on both counts; and that the City Council <br />action was supported by record, consistent with their authority <br />and interpretation of state and local law, and dismissed both <br />those claims. <br />City Attorney Squires advised that the second portion of the <br />lawsuit related to the MERA was not deemed an appropriate <br />decision through summary judgment and was denied for <br />determination through trial in a fact-intensive format. <br />
