E. Access doorways must be planned that will not empty directly into the path of the <br />drive-through. This can be done with a new striped walkway and protective <br />bollards along the building wall, west of the drive-through window. <br />F. Prior to a building permit being issued for redevelopment of the site, the applicant <br />must post a landscape bond, letter of credit, or other security acceptable to the <br />City, in an amount equal to 150% of the cost of landscaping, trash enclosures, <br />and site paving and curbing installation. The specific amount of this security shall <br />be determined by the Community Development Director following completion of <br />all site construction plans. <br />G. T�.e conditional use permit will expire within six months of the date of City <br />Council approval if a building permit is not obtained for the approved <br />development (Section 1013.03 of the City Code). <br />H. Minor variations from the approved plans may be approved by the City's <br />Development Review Committee, under the direction of the Community <br />Development Director; however, any substantial departures from the approved <br />plans will require an amendment to the conditional use permit. <br />8.0 PLANNING COMMISSIONACTION: <br />8.1 On September 7,2005, the Roseville Planning Commission held the public hearing <br />regarding the Love From Minnesota request. At the hearing no citizens were present to <br />address the Goz��.��sszon. However, Commissioners did have questions and comments of <br />staff and the ownerlapplicant regarding the proposed drive-through window. <br />8.2 Specifically, Commissioner Bakeman asked if the wine store door would open onto (near) <br />the drive lane and how would pedestrians be protected (door currently located on north <br />side of structure as is the access to the Dunn Bros. facility — pedestrians safety would <br />occur through a protected walkway, curb, or other device). <br />8.3 Commissioner poherty expressed concern over the location of E�e northwestern most on- <br />site parking stall and its proximity to (potential conflict with) the drive-through lane. <br />Staff indicated that they would work with the applicants on the potential elimination of <br />said stall — if detem�i��ed to be in conflict with by-pass lane. <br />8.4 Chair Traynor asked for clarification on site access (vehicles would enter on north and <br />travel a one-way around building and exit at south access to Fairview Avenue) <br />8.5 Commissioner Boerigter asked what constitutes the appropriate drive-through count for <br />this facility (5 vehicles) and whether that number or length within the parking was <br />adequate (yes). <br />PF3672_RCA_092505 - Page 6 of 7 <br />
