Discuss Changes to Rosev�lte's Ordinance on Above-Ground <br />Fuel Storage Tanks and Zoning Strategies to Prohibit Future <br />Underground FuellChemical Storage in Twin Lakes and <br />other Redevelopments <br />Councilrnernber Ihlan had requested a preliminary discussion of <br />potential changes to City ordinance on above-ground fuel storage <br />tanks; and possible zoning strategies to prohibit future <br />underground fuellchemical storage in Twin Lakes and other <br />redevelopment areas (City Code, Section 902.06). <br />Councilmember Ihlan had also suggested that the City redefine <br />boundaries for the City's industrial area using New Brighton <br />Boulevard, rather than the City's western City limits. <br />Councilmember Ihlan specifically questioned whether the City <br />Council should repeal Section 942,06C that would allow the City <br />to grant exceptions in non-residential neighborhoods. <br />Mayor Klausing sought clarification from City Attorney Squires <br />as to the affect repealing that language would create related to <br />strict application of the law. <br />City Attorney Squires recommended the clause remain to allow <br />the City Council a mechanism to consider applications on a case <br />by case basis. Mr. Squires noted that the statutory scheme <br />allows the City leeway for granting a variance from any section <br />of the code. <br />Councilmember Maschka provided a historical perspective of <br />this section of City Code, noting that it had been deliberately <br />worded, anticipating a long-term redevelopment for the Twin <br />Lakes area and existing trucking needs, and the need to allow for <br />transitions during that redevelopment process. Councilmember <br />Maschka opined that the language in Section 90�.06� should <br />remain as is. <br />Discussion included variances; types of petroleum products; <br />safety concerns; transition timeframes; and pollution clean up <br />preferences. <br />Mayor Klausing opined his preference for leaving Section <br />Above-Ground <br />Fuel Storage Tanks <br />& <br />Zoning Strategies <br />to Prohibit Future <br />Underground <br />FuellCh�mical <br />Storage <br />
