City Council Regular Meeting — 09/26/OS <br />DRAFT Minutes - Page 15 <br />City Attorney Scott Anderson opined that there would be no <br />liability on the City's part; that the City was protected by law and <br />their duty to protect the public as a whole through their public <br />duty doctrine. <br />Councilmember Ihlan questioned whether the 14-day <br />requirement language was applicable to regular massage <br />establishments, and possibly created a loophole for people to set <br />up for 13 days, and move on to another location; and questioned <br />the overall structure of the ordinance. <br />City Attorney Anderson concurred with Councilmember Ihlan's <br />interpretation that a loophole may be created. <br />Additional discussion included language amendments to correct <br />the intent to allow short-term practice of massage within certain <br />businesses without the necessity of obtaining a license. <br />City Attorney Anderson suggested an additional clause be added. <br />Mayor Klausing directed staff and City Attorney Anderson to <br />work out language and bring before the City Council at their <br />October 10,2005 regular meeting on the Consent Agenda. <br />City Manager Beets noted that provisions were made by the <br />recipient of the massage to be fully clothed; and that provisions <br />in the sexually-oriented businesses ordinance would address <br />similar concerns. <br />There was no public comment; and no one appeared for or <br />against. <br />Mayor Klausing closed the Public Hearing at 7;14 p.m. <br />7. Consider a Joint Powers Agreement for Engineering Services <br />with Falcon Heights and Arden Hills <br />Public Works Director Duane Schwartz reviewed the proposal <br />for the City of Roseville to provide some engineering services to <br />the Cities of Arden Hills and Falcon Heights; previous Council <br />discussions and preferences in July of 2005; and the specific <br />requirements of each City. <br />JPA <br />Engineering <br />Services with <br />Falcon Heights and <br />Arden Hills <br />
