City Council Regular Meeting — 09/26/OS DRAFT Minutes - Page 15 City Attorney Scott Anderson opined that there would be no liability on the City's part; that the City was protected by law and their duty to protect the public as a whole through their public duty doctrine. Councilmember Ihlan questioned whether the 14-day requirement language was applicable to regular massage establishments, and possibly created a loophole for people to set up for 13 days, and move on to another location; and questioned the overall structure of the ordinance. City Attorney Anderson concurred with Councilmember Ihlan's interpretation that a loophole may be created. Additional discussion included language amendments to correct the intent to allow short-term practice of massage within certain businesses without the necessity of obtaining a license. City Attorney Anderson suggested an additional clause be added. Mayor Klausing directed staff and City Attorney Anderson to work out language and bring before the City Council at their October 10,2005 regular meeting on the Consent Agenda. City Manager Beets noted that provisions were made by the recipient of the massage to be fully clothed; and that provisions in the sexually-oriented businesses ordinance would address similar concerns. Consider a Joint Powers Agreement for Engineering Services with Falcon Heights and Arden Hills Public Works Director Duane Schwartz reviewed the proposal for the City of Roseville to provide some engineering services to the Cities of Arden Hills and Falcon Heights; previous Council discussions and preferences in July of 2005; and the specific requirements of each City.
