By adopting the ordinance, staff will have better clarity and more authority to address <br />neighborhood issues relating to property maintenance. <br />3.3 The ordinance will also be the basis for the reauired inspection under the proposed <br />rental licensin� ordinance. (It is unclear at this time whether the existing code compliance <br />staff has the time to serve the increase levels of complaints of other city-wide property and <br />building issues. Additional time and evaluation of the work load will be necessary.) <br />�.ti'1 Proposed Rental Licensin� Ordinance —(Attachment B) <br />��. � The draft rental license ordinance includes an annual inspection of all rental properties <br />containing 4 or fewer units. <br />�.� Each rental owner must make an application for the rental license and comply with rental <br />license code as well as the property maintenance code. An inspection will occur to validate <br />if the property is in compliance. If the property is in compliance, a license will be issued. <br />�. � If the property is not in compliance, a correction notice will be issued allowing the owner a <br />— reasonable time to make the corrections prior to a re-inspection. <br />•�.•� If compliance can not be achieved, aprocess for compliance would include the issuance of a <br />penalty (court citation or administrative penalty) and an additional notice to correct plus an <br />abatement process whereby the city orders the work to b e completed and charges the property <br />with the cost of the correction added to the property taxes. <br />�k � The draft ordinance describes how the City Council will designate the HRA as the <br />administrating entity of the program. It is proposed that the HRA fund the program costs <br />through the HFtA levy. Any changes to the process would need to be adopted by the City <br />Council through an ordinance amendment. <br />iE. �a In addition, the ordinance provides that the HRA serve as the Appeal Board to 3�Tr��i �� the <br />Council on issues where a property owner is appealing the ordinance andlor compliance <br />issues relating to rental housing. The final decision on all appeals is the decision of the City <br />Council. <br />�. � Who should staff this effort? As noted above, building inspection services are now at <br />capacity and will be for years. Staff is suggesting that the HRA first review the possibility <br />of contracting for the inspection services through an outside agency. (The Housing <br />Resource Center has declined the offer to provide this service.) Other opportunities are <br />being explored that include a"Request For Proposa3s"(RFP} from private housing <br />inspectors or partnering with other cities for the services such as Little Canada, <br />Shoreview, New Brigl�ton or Mounds View. Whoever the new inspectors are, they will <br />need access to existing records within both the city's planning and building inspection <br />files. <br />�� How will the uro�ram be funded?
