�� � � � <br />CITY of ROSEVILLE <br />PLANNED UNIT DEVELOPMENT AGREEMENT # <br />This PLANNED UNIT DEVELOPMENT AGREEMENT, dated October 24,2005 is <br />entered into between the City of Roseville, a Minnesota municipal corporation, of 2660 Civic <br />Center Drive, Roseville, Minnesota 55113 ("CITY") and Minnesota Industrial Ventures, <br />LLC, at 4900 Viking Drive, Edina, MN 55435 ("DEVELOPER"). For reference, the PIN is: <br />042923320036 and the City of Roseville project file is: �'F3G83. <br />1.0 EFFECTIVE DATE of AGREEMENT: <br />This Agreement shall be effective upon completion of all of the following: <br />1.1 Passage and publication of Ordinance # (rezoning of properiy to PUD). <br />1.2 Publication of the ordinances in the Roseville Review, the C�TY'� official <br />newspaper. <br />13 Execution of this Agreement by the CITY and the DEVELOPER. <br />1.4 Recording of this Agreementwith the Ramsey County Recorder. <br />2.0 REQUEST for PUD APPROVAL: <br />The DEVELOPER has requested that the CITY approve a Planned Unit %�ev ��oprnent <br />that provides for the r�use of tenant space within the multi-tenant structure at 2700 to <br />2812 Fairv�ew Avenue. <br />The legal description for this development is: <br />Exhibit ��A" Attached <br />3.0 PUD APPROVAL: <br />The CITY hereby grants approval of the amended Planned Unit Development (identified <br />as Exhibits A through _ in Section 4.0 of this Agreement), subject to the <br />DEVELOPER's compliance with the terms and conditions of this Agreement. The City <br />agrees to approve applications for building permits, if said applications are consistent <br />with the plans identified in Section 4.0 below. <br />For any improvements not contemplated in this Agreement, the CITY may require <br />compliance �J�f�h any amendments to the Comprehensive Guide Plan, official controls, <br />platting or dedication requirements enacted after the date of this Agreement. <br />
