4.0 APPROVAL by the CITY: <br />The CITY hereby approves the following EXHIBITS (plans and agreements) on file with <br />the City. The DEVELOPER shall develop the subj ect property in accordance with these <br />EXIIIBITS. If, however, the plans are inconsistent with the written terms of this <br />Agreement, the written terms of this Agreement shall controL If the plans address items <br />not specifically addressed in this Agreement, the plans shall govern with respect to those <br />items. The plans are: <br />Exhibit A Alta Survey indicating all features of and on the subjectparcel, dated <br />,2005. <br />Exhibit B Master Easement Document identifying all easements not included on the <br />lots such as (but not limited to) bus routes, access or drive lanes into and <br />out of the site, cross parking easement, shared parking easement, parking <br />easements, storm water pond easements, etc. dated _� 2005. <br />5.0 REZONING: <br />The CITY conducted a hearing on October 5,2005 (Planning Commission— �[JD/B-b <br />Rezoning). On October 24,2005 the City Council considered the proposed Rezoning and <br />Planned Unit Development Agreement and found the proposal to be consistent with the <br />City ComprehensivePlan and City Code. The CITY agrees to REZONE the property <br />subj ect to the DEVELOPER's strict compliance with the approved plans, and terms and <br />conditions of this Agreement. <br />Minor departures from the approved final development plans, which are consistent with <br />this Agreement and the underlying zoning of B-6, Mixed Use Business Park may be <br />approved by the CITY's DevelopmentReview Committee and the Community <br />Development Director or designee, as provided in the Roseville City Code (Section <br />1008). Where not supersededby more restrictiverequirements of this PUD, the standards <br />of the underlying zones shall apply, as stated in Chapter 1005 of the Roseville City Code. <br />Whether an issue is "minor" or "significant" shall be determined by the CITY as defined <br />in Section 1008.09 of the City Code. <br />6.0 COMPLIANCE with LAWS and REGULATIONS: <br />The DEVELOPER represents to the CITY that, to the best of its knowledge, any site <br />improvements pursuant to the proposed development will comply with all City, County, <br />Watershed, Regional, Metropolitan, State, and Federal laws and regulations, including <br />but not limited to the Roseville Subdivision Regulations, the Roseville Zoning <br />Regulations, and all other applicable environmental regulations. <br />'7,p PUD STANDARDS and CONDITIONS of APPROVAL: <br />The Planned Unit Development (PUD) shall also comply with the following specific <br />PUD standards: <br />
