3.0 Proposed Housing Preservation l Maintenance Code –(Attachment A and C) <br />3.1 After years of review, staff is suggesting, with the support of the �,R.A and Planning <br />Commission, that the Council adopt the International Property Maintenance Code, 2003 <br />Edition, with minor amendments to concur with the existing City Code and State <br />Building Code. (See Attachment C) Currently the State is evaluating adoption of the <br />IPMC for acceptance in Cities, similar to the building code, which would provide <br />continuity in application of city codes throughout the region. <br />3.2 The ordinance would provide minimal acceptable standards for maintenance of existing <br />building, structures, premises and facilities to protect health, safety and general welfare of <br />the City. By adopting the ordinance, staff will have better clarity and more <br />authority to address neighborhood issues relating to property maintenance. <br />3.3 The ordinance will also be the basis for the reauired insnection under the nronosed <br />rental licensin� ordinance. (It is unclear at this time whether the existing code <br />compliance staff has the time to serve the increase levels of complaints of other city-wide <br />property and building issues. Additional time and evaluation of the work load will be <br />necessary.) <br />4.0 Proposed Rental Licensin� Ordinance –(Attachment B) <br />4.1 The draft rental license ordinance includes an annual inspection of all rental properties <br />containing 4 or fewer units. <br />4.2 Each rental owner must make an application for the rental license and comply with rental <br />license code as well as the property maintenance code. An inspection will occur to <br />validate if the property is in compliance. If the property is in compliance, a license will <br />be issued. <br />43 If the property is not in compliance, a correction notice will be issued allowing the <br />owner a reasonable time to make the corrections prior to a re-inspection. <br />4.4 If compliance can not be achieved, a process for compliance would include the issuance <br />of a penalty (court citation or administrative penalty) and an additional notice to make the <br />corrections plus an abatement process wherebythe city orders the work to be completed <br />and charges the property with the cost of the correction added to the property taxes. <br />4.5 The draft ordinance describes how the City Council designates the HRA as the <br />administrating entity of the program. It is nronosed that the HRA fund the prd�ram <br />costs through the HRA levy. Any changes to the process would need to he adopted <br />bY the City Council throu�h an ordinance amendment. <br />4.6 hi addition, the ordinance provides that the HRA serve as the Appeal Board to 2����a_;c- the <br />� Council on issues where a property owner is appealing the ordinance axzdlor compliance <br />— issues relating to rental housing.
