elected by the Participant under the Plan. If no benefits are elected, or if the total cost of the <br />benefit(s) elected by the Participant is less than the Employer contribution allocated thereto, <br />Employer contributions may be disbursed to the Participant in the form of additional taxable <br />compensation benefits under Section 5.3, if otherwise provided for by the Employer. The <br />Employer will inform Plan Participants prior to the commencement of each Plan Year of the <br />amount, if any, of such Employer contributions to be made during the Plan Year. If excess <br />Employer contributions are not disbursed by the Employer as taxable compensation to the <br />Participant, any excess Employer contributions shall be retained by the Employer and the <br />Participants and shall have no further claim to that amount. <br />Section 4.4 Benefit Selection. A Participant's initial benefit election shall be made as <br />part of the application to participate. Thereafter, subject to such reasonable restrictions, if any, as <br />the Employer may impose on a uniform basis, a Participant may change his or her election for a <br />subsequent Plan Year by providing written notice to the Employer, on forms prescribed by the <br />Employer and at such time as is prescribed by the Employer, to elect or waive participation in the <br />Employer sponsored health, dental plan and/or life insurance plan(s) as well as the Health <br />Savings Account (HSA). The Employer or any provider of benefits hereunder may impose <br />restrictions on the election of benefits under the Plan. The Employer, in its discretion, may <br />utilize a"negative election" form for certain plan contributions. A negative election form is a <br />form that assumes that the Participant desires to make certain contributions on a pre-tax basis. <br />Negative elections may be used only for health, dental plan and/or life insurance plan(s) <br />premiums. Negative elections shall not be used for medical expense reimbursement under <br />Section 5.2.2 or dependent care reimbursement under Section 5.2.3.
