Plan Year, if the Participant becomes re-employed after a period of thirty (30) days or longer. If <br />the Participant returns to employment within thirty (30) days, the Company may re-instate the <br />Participant's original election for that Plan Year. <br />Section 4.7 Cessation of Required Contributions. A Participant's election to receive a <br />benefit under this Plan shall be automatically revoked effective the first day of any period for <br />which such Participant fails to make a contribution required by the Employer for such benefit for <br />such period including those periods under which the Participant is on a Family or Medical Leave <br />as defined in Section 3.5. <br />Section 4.8 Adjustments to Prevent Discrimination. If the Employer believes that the <br />Plan or any of its benefits might otherwise be deemed discriminatory under any provision of the <br />Code, it may, in its absolute discretion, limit or reduce the amount of Employer contributions, if <br />any, and Pay Conversion Contributions of such Participants allocated to such benefits described <br />herein in such amounts as are necessary, in its good faith judgment, to avoid such discrimination; <br />provided that any such limitation imposed by the Employer shall apply on a uniform basis among <br />the affected Participants. <br />Section 4.9 Available Benefits. The Employer shall maintain and make available to <br />Participants accurate lists and descriptions of the respective types, amounts, and costs of benefits <br />available through the Plan. Each Participant shall be notified in writing if there is (a) a change in <br />the cost of a benefit or (b) a change in the type, nature, or amount of any benefit. <br />26 City of Roseville MPD <br />
