Attachment A <br />PUSLIC IMPROVEMENT CONTRACT <br />SIENNA GREEN ADDITION <br />5 I. Parties. This Agreement, dated , 2009, is entered into between the City of <br />6 Roseville, a Minnesota municipal corporation, of 2660 Civic Center Drive, Roseville, Minnesota <br />7 55113 ("the City"), and Snelling Avenue, LLC, ("the Developer"). <br />8 II. Request for Plat approval. The Developer has asked the City to approve a plat of land to be <br />9 known as SIENNA GREEN ADDITION (also referred to in this contract as the "plat") . The <br />�o land is legally described as follows: <br />� � The South 7 acres of the Northeast Quarter of the Southeast Quarter of the Southeast <br />12 Quarter (NE1/4 of SE1/4 of SE1/4 ), Section Nine (9), Township Twenty-Nine (29), Range <br />�3 Twenty-Three (23), according to the Government Survey thereof. <br />14 <br />�5 Subject to the rights acquired and to be acquired by the State of Minnesota for highway <br />�6 purposes in that part of the above described tract lying Northerly and Easterly of the <br />�7 following described line: <br />�s <br />�9 Seginning at a point on a line run parallel with and distant thirty-three (33) feet West of <br />20 the East line of said Section Nine (9) distant seven hundred sixty (760) feet North <br />2 � (measured along said East Section Line) from the Southeast corner thereof; thence run <br />22 Northwesterly to a point which is 945 feet North and 175 feet West from said Southeast <br />23 corner; thence run Northwesterly to a point on the North line of the South 7 acres of the <br />24 Northeast Quarter of the Southeast Quarter of the Southeast Quarter (NE1/4 of SE1/4 of <br />25 SE1/4 ) of said Section 9, distant 220 feet East of the Northwest corner thereof and thence <br />26 terminating. <br />27 <br />28 <br />29 <br />30 <br />31 <br />Subject also to the rights of the public in Snelling Avenue and in the frontage road. <br />Ramsey County, Minnesota <br />32 III. Terms and Conditions of Plat Approval. Now, therefore, in reliance upon the representations <br />33 contained herein; and in consideration of the mutual undertakings herein expressed, the parties <br />34 agree as follows: <br />35 A. Conditions of Plat Approval: The Developer shall comply with any and all applicable City, <br />36 County, Metropolitan, State and Federal laws and regulations including, but not limited to: <br />37 subdivision ordinances, zoning ordinances and environmental regulations that may apply to <br />38 the plat and its development. <br />39 S. Land Use Approvals: The plat consists of site and existing building improvements to the <br />40 Har Mar Apartments, 2225 to 2265 Snelling Avenue and to develop a new 50-unit, 4-story <br />4� apartment building on Lot 1, Slock 1 of the plat. <br />42 C.
