December 2, 2009 <br />The Department allows �atrol officers and s�rgeants to �id hours worked based on <br />seniority. Throug�ou� my career; fhe most senior patrol officers and sergeants bid <br />the day hours wf�ich leaves ti�e most j�nior officer5 and sergear�ts working the night <br />shif� hours. A general r�le is the more junior afficers make more traffic and <br />pedestrian stops and wrife more traffic ar�d criminal citations ihan senior officers. A <br />natural by-product ofi increased activity means the officer wiil testify in court more <br />often than a senior counter part, ar�d on over�ime basis as the trials will take place <br />during narmai business haurs. <br />Suburba� depariments have na cantrol o�er the court calendar in Minnesota, other <br />than maKing requests. Se�eral years ago fhe Department as�Ced the Caurt to bundle <br />court dates if an officer is scheduled t� atfend couri multiple times in a week. <br />All Department officers are members of Law Enforcement Labar Services (LELS) <br />and sergeants are members of ihe Teamsters Union. Labor activities are governed. <br />by labar contracts. Officers arrd Sergeants who attend court off duty ar� to be <br />compensated at an o�ertime rate with a minim�am of three ar three and on�-half <br />haurs, depending on the length of time they received notice to appear in court. <br />Members of the Department do not attend court unless they are s�bpaenaed io <br />t�stify. Once subpoenaed, aftendance is mandatory under penalty of law. <br />As detaiied above; the Department has �irt€�ally no control over the amaunt of <br />overtime related #o caurt. <br />Traininq <br />Training in law enfarcement is paramount to maintaining the Deparkment's personnel <br />with current trends, court decisians and legal updates. Police officers deal with a <br />myriad of issues invalving peopfe experiencing acute or long term problems: <br />Depar�ment members are expected to professionally hand[e traffic issues, animal <br />complaints, the emot�anally distur�ed and a11 crimes in progress from minor thefts fo <br />the most serious felany crimes. There is no more variety of duties performed by any <br />City employee than those handled by fl�e Police Department; thus, the ongoing <br />training �f Departmenf inembers must be protected. <br />Even so, the Department has taken numeraus measures in th� past few years ta <br />minimize over�ime assaciated wit� training. In 2009, the Deparfinent mandated that <br />al[ career enhancement fraining be completed during a scheduled work day and not <br />an overtime. Still, some important training �opics, such as crisis intervention training, <br />supplied by an outside exper�, may only be offered when employees are on <br />scheduled days off. Unian cantracts do not allow the Depa�tment to alter the <br />employees' days off to att�nd training in lieu af a regularly workday. <br />3 <br />
