December 2, 2009 <br />Mar�y police exper#s have written that nofhing i� law enforcement is more important <br />than proper training. Numerous federal court decisions have indicated that police <br />training is not a luxury but a criticaf responsibil�ty. Training ir� aspects of an officer's <br />duties must be campleted privr ta the officer's exposure to thaf topic. <br />City of Canton; Ohio � Harris, 1989, is a foundir�g decision on police fraining. In <br />summary, the U. S. Supreme Court held that police officers may make mistakes and <br />liability can only at�ach where tf�e city's failure-to-train reflec�s delibera�e indifference <br />to the constitutionaf rig�ts af cifizens. Training should directly correspond �o <br />recurring iasks of police work. Future limiting of iraining in the Department may ha�e <br />ci�i! liability impfications. <br />The attached spread sheet ir�dicates overtime accrued due to training has <br />decreased since the a�ove measures have been implemented. <br />The Department employs instructor levef trainers in several areas to include: Use of <br />Force, Firearms, Emergency Vehicle Qperatians, and Pursuit Intervention Technique <br />(PIT). T�is affords aur Depar�ment the oppartunity to tailor the instruction to our own <br />g€aidelines and �epartment policies and procedures. Each instructor requires <br />periodic recertification at times and locations se� by the outside enfity which provides <br />the instructor Ie�eI recertification. <br />In�estiqations <br />The "In�estigations" over�ime calumns are directly re[ated to prac�ssir�g major <br />crimes in order ta comply with the rules of criminal procedure (see below) and are <br />out o� the Department's cantral. <br />Late Call <br />The Department has made great strides in reducing the amount of accrued o�ertime <br />relafed to officers and sergear�ts completing ca[Is for service and written reporfs after <br />their assigned shift ends. In 2008, the D�partment's patrol staff af 37 maved from an. <br />8.5 to a 12 hour workday. This change allowed far more officers an pairol when calls <br />for service are af their highest. The change also afforded officers the opportur�ify ta <br />com�let� th� many reports required to document the important details of crimes <br />befare the �nd of their assigned shifts. As the attached document indicates, the <br />overtime associated rrvith °Late Call" has been reduced 66% since 2Q07. <br />The Department alsa directs officers to compl�te minor reports upon fheir return to <br />work the next shift rather than on an overtime basis. <br />Still, o�ertime will be accrued as Minnesota Rules of C�imi�al Pracedure mandate <br />suspects ta�Cen in�a custody must �e criminally charged or released fram custady <br />within 36 hours of arrest.
