On lots 2 and 3, 6 and 7, air con�litioning (AC) units must be placed between town <br />home units; on Lots 4 and 5, ,�� units must be placed on the south side of the <br />town home; and on Lots 1 and 8j, AC units must be placed on the north side of the <br />town home. AC units located an Lots 1, 4, 5, and 8 must be screened from view <br />and include reduced noise levels. <br />f. Site lighting (pedestrian scale carriage style) must be downcast and not shed glare <br />at adj acent properties (subj ect to staff approval). (as/Member Bakeman) <br />g. The existing water well must be properly capped and all buildings, tree branches <br />and roots, debris, and any soil contamination (subj ect to MnPCA requirements) <br />must be removed from the site (�ot spread, buried, or burned on the site) prior to <br />the issuance of a building permit. <br />h. Park dedication is required. Staff recommends for this development a cash <br />payment in lieu of land dedication because the Park System Plan does not require <br />additional park land in this area of the community. The payment amounts to <br />$1,000 per unit or $8,000. The Park and Recreation Commission will review this <br />before final Council approvals. <br />i. Review and support of the Comprehensive Land Use Plan Amendment from LR <br />to MR by the Metropolitan Coumcil. <br />j. A landscape plan must be completed in cooperation with the neighbors, with <br />screening along the south edge af the proposed road (as/ Chair Mulder). <br />k A Homeowner Association must be completed, filed with the City and the PUD <br />(as/ Member Stone). <br />1. Patios between units (except sidewalks) are prohibited (as/Member Bakeman). <br />m. No additional outbuildings may be placed on the site (as/Chair Mulder). <br />9.0 DEVELOPER MODIFICATIONS: <br />9.1 As a general rule, a General Concept Planned Unit Development is a set of plans that are <br />a"work in progress". These plans receive modifications throughout the process until the <br />Final Development Plan is approved by the City Council. <br />9.2 Since the March 3,2004 Planning Commission meeting the developer has made a number <br />of modificationsto this proposal, which reflect staff comment and the recommendation of <br />the Planning Commission. <br />9.3 The revised submittal includes on site parking for the eight vehicles recommended by <br />staff and the Planning Commission.
