City Council Study Session — 04/19/04 <br />DRAFT Minutes - Page 4 <br />Mayor Klausing sought to clarify Mr. Kennedy's specific <br />request as it related to process. <br />Councilmember Schroeder interrupted with another Point <br />of Order, dissuading discussion outside the process of <br />directing complaints to the City Attorney or City Manager. <br />Mayor Klausing requested clarification from City Manager <br />Beets as to the process to be followed by Mr. Kennedy. <br />City Manager Beets responded that, as per previous City <br />Council direction, complaints about City staff were to be <br />directed to the City Manager's attention; and complaints <br />about the City Manager or against an elected official were <br />to be directed to the City Attorney. <br />Mayor Klausing sought clarification from City Attorney <br />Squires that Mr. Kennedy's complaint should be in written <br />format. <br />City Attorney Squires confirmed that, while not all that <br />common, the complaint should be filed in written form; at <br />which time the City Attorney's office would review the <br />complaint, gather any additional information required to <br />address the matter, and properly advise the City Council <br />whether action was required or if there was jurisdiction to <br />pursue the complaint, as per the City's Ethics Resolution. <br />Mr. Kennedy requested a copy of the Ethics Resolution; <br />and Mayor Klausing directed City Manager Beets to <br />provide the material to Mr. Kennedy. <br />Councilmember Kough brought up an unrelated issue <br />regarding concerns expressed to him regarding an Advisory <br />Board member coming before the City Council and using <br />inappropriate language; questioning whether citizens <br />serving on boards could be disciplined and how to handle <br />decorum in future similar situations, in addition to elected <br />official perceived behavior. Councilmember Kough had <br />requested that City Attorney Squires' office provide copies <br />of sample "Rules of Procedure and Decorum," for possible <br />Council consideration. <br />
