City Council Study Session — 04/19/04 DRAFT Minutes - Page 4 Mayor Klausing sought to clarify Mr. Kennedy's specific request as it related to process. Councilmember Schroeder interrupted with another Point of Order, dissuading discussion outside the process of directing complaints to the City Attorney or City Manager. Mayor Klausing requested clarification from City Manager Beets as to the process to be followed by Mr. Kennedy. City Manager Beets responded that, as per previous City Council direction, complaints about City staff were to be directed to the City Manager's attention; and complaints about the City Manager or against an elected official were to be directed to the City Attorney. Mayor Klausing sought clarification from City Attorney Squires that Mr. Kennedy's complaint should be in written format. City Attorney Squires confirmed that, while not all that common, the complaint should be filed in written form; at which time the City Attorney's office would review the complaint, gather any additional information required to address the matter, and properly advise the City Council whether action was required or if there was jurisdiction to pursue the complaint, as per the City's Ethics Resolution. Mr. Kennedy requested a copy of the Ethics Resolution; and Mayor Klausing directed City Manager Beets to provide the material to Mr. Kennedy. Councilmember Kough brought up an unrelated issue regarding concerns expressed to him regarding an Advisory Board member coming before the City Council and using inappropriate language; questioning whether citizens serving on boards could be disciplined and how to handle decorum in future similar situations, in addition to elected official perceived behavior. Councilmember Kough had requested that City Attorney Squires' office provide copies of sample "Rules of Procedure and Decorum," for possible Council consideration.
