6.0 STAFF COMMENTS/FINDINGS: 6.1 Section 1005.015 of the City Code of the B-2 District (recently amended) identifies outdoor display and storage as a use which must receive a conditional use permit, presumably because of the questionable maintenance, litter, traffic, and noise in business centers. 6.2 Chapter 1010 outlines design standards regulations for commercial and industrial development witl�in the community. These standards are applied to new construction as well as enlargements or alterations of existing buildings and/or uses. 6.3 Section 1013.01 outlines the process and standards for issuance of a conditional use permit. 6.4 The Community Development Department supports the display of seasonal merchandise, but only within a limited size and not under the fuel canopy. This support and limited area is consistent with the 1999 approval of a Planned Unit Development for Speedway SuperAmerica allowing the existing gas/convenience store at 2785 Harnline Avenue to be redeveloped. This approvallimited the placement and amount of inerchandise displayed on the premised as follows: Outdoor and e�erior storage or sales display sha11 be prohibited, except by conditional use permit. Sa1es of seasonable items witl�in a 30 sauare foot area between the store's entry and exit are permitted. These include, but are not limited to soda pop/beverage, washer fluid, charcoal and wood. An ice machine, AM Express depository and Fed Ex depository are permitted witl�in a 24 sauare foot area located along the southeast facade. No accessory buildings shall be allowed on the site. Outdoor loudspeaker for the purpose of public safety is permitted. All other loudspeaker use prohibited. 6.5 In reviewing this request, staff has made the following findings: The storage and display on the site adjacent to the building (not under the fuel canopy) will ha�e a minimal impact on traffic in the area, as the use of the property will not be changing. 2. The proposed storage and display on the site adjacent to the building (not under the fuel canopy) will not have an impact on parks, streets and other public facilities. 3. The storage and display on the site adjacent to the building (not under the fuel canopy) will be compatible with contiguous properties. 4. The storage and display on the site adjacent to the building (not under the fuel canopy) will not have an adverse impact on the market value of contiguous properties.
