6.0 STAFF COMMENTS/FINDINGS: <br />6.1 Section 1005.015 of the City Code of the B-2 District (recently amended) identifies <br />outdoor display and storage as a use which must receive a conditional use permit, <br />presumably because of the questionable maintenance, litter, traffic, and noise in business <br />centers. <br />6.2 Chapter 1010 outlines design standards regulations for commercial and industrial <br />development witl�in the community. These standards are applied to new construction as <br />well as enlargements or alterations of existing buildings and/or uses. <br />6.3 Section 1013.01 outlines the process and standards for issuance of a conditional use <br />permit. <br />6.4 The Community Development Department supports the display of seasonal merchandise, <br />but only within a limited size and not under the fuel canopy. This support and limited <br />area is consistent with the 1999 approval of a Planned Unit Development for Speedway <br />SuperAmerica allowing the existing gas/convenience store at 2785 Harnline Avenue to be <br />redeveloped. This approvallimited the placement and amount of inerchandise displayed <br />on the premised as follows: <br />Outdoor and e�erior storage or sales display sha11 be prohibited, except by <br />conditional use permit. Sa1es of seasonable items witl�in a 30 sauare foot area <br />between the store's entry and exit are permitted. These include, but are not <br />limited to soda pop/beverage, washer fluid, charcoal and wood. An ice machine, <br />AM Express depository and Fed Ex depository are permitted witl�in a 24 sauare <br />foot area located along the southeast facade. No accessory buildings shall be <br />allowed on the site. Outdoor loudspeaker for the purpose of public safety is <br />permitted. All other loudspeaker use prohibited. <br />6.5 In reviewing this request, staff has made the following findings: <br />The storage and display on the site adjacent to the building (not under the fuel <br />canopy) will ha�e a minimal impact on traffic in the area, as the use of the <br />property will not be changing. <br />2. The proposed storage and display on the site adjacent to the building (not under <br />the fuel canopy) will not have an impact on parks, streets and other public <br />facilities. <br />3. The storage and display on the site adjacent to the building (not under the fuel <br />canopy) will be compatible with contiguous properties. <br />4. The storage and display on the site adjacent to the building (not under the fuel <br />canopy) will not have an adverse impact on the market value of contiguous <br />properties. <br />PF3588 - RCA 08/23/04 - Page 3 of 5 <br />
