City Council Regular Meeting — 08/09/04 <br />DRAFT Minutes - Page 9 <br />Councilmember Ihlan further opined that the Council was being <br />forced to make numerous incremental decisions without that <br />comment being received; and questioned whether the process <br />was protective of public and/or City interest. <br />Mayor Klausing recommended hearing the reports and updates <br />this evening, along with staff's response; and to schedule a <br />separate time for public comment in a Council setting. <br />City Manager Beets responded to Council comment by noting <br />that this item had been listed on the meeting agendas numerous <br />times; e-mails, letters, faxes and verbal comment had been <br />provided to the City Council, including those written comments <br />included in tonight's Council packet, as well as the public <br />comment heard at each meeting. City Manager Beets opined that <br />there had been received substantial public input to-date; noting <br />that staff needed direction at tonight's meeting as to whether <br />there was a project on which to hold a Public Hearing, as <br />outlined by State law and City Code. Mr. Beets further noted <br />that staff was recommending extensive legal, written notice, <br />beyond the 350' mandated under State Statute to be held at the <br />Planning Commission level, followed by the City Council level. <br />Councilmember Ihlan reiterated her concern that staff continue to <br />seek incremental guidance for various components; opining that <br />she was prepared to make a motion to facilitate discussion, to <br />hold a formal Public Hearing for the express purpose of hearing <br />comment on the project's financial feasibility. Councilmember <br />Ihlan further opined that the City Council and staff had other <br />issues on which to concentrate (i.e., budget) and needed to <br />maintain a formality in the process. <br />Mayor Klausing recognized Councilmember Ihlan's concern to <br />receive public formal input prior to the September 30, 2004 <br />deadline outlined in the Exclusive Rights of Negotiation <br />Agreement between the City and Rottlund Homes as Master <br />Developer.
