c. The Snelling Avenue frontage road adj acent to Perkins, the office building, and <br />Midas will be closed off to County Road B. <br />d. An additional lane for right turns only from County Road B on to Snelling <br />Avenue will be added to County Road B adj acent Midas and the car wash, which <br />design may impact current site access, but should not require access removal. <br />5.14 The City, through the subdivision platting process, has the ability to require the <br />dedication of public right-of-way in order to provide for public services. The City has <br />determined, because of the future improvements to the County Road B and Snelling <br />Avenue intersection, that a 50 foot wide public right-of-way is necessary and must be <br />dedicated over the proposed west access road within the Target site, which right-of-way <br />will need to be slightly larger at County Road B due to the right turn-idright turn-out <br />design. It is anticipated that a 28 to 32 foot wide public road will be constructed within <br />the right-of-way connecting County Road B to Commerce Street. <br />5.15 Should it be determined in the future that the full right-of-way is unnecessary due to final <br />design plans (by MnDOT, Rarnsey County, and the City), the City would initiate the <br />vacation of all unnecessary right-of-way to Target Corporation. <br />5.16 Easement will also be required along the periphery of each lot and for all public <br />easements, including water, sanitary sewer, and storm sewer. Private easements, such as <br />the relocation of the private access easement may be required (depending on final <br />roadway plans) at the time the final plat is recorded with Ramsey County. <br />REVIEW of REZONING: <br />5.18 The land that encompasses the area south of Commerce Street to County Road B and <br />from Snelling Avenue east to Pascal Street has been zoned Shopping Center since the <br />Village of Roseville adopted the first zoning code in 1959. However, the site and the past <br />and present uses have never function as a"shopping center" as defined by the current <br />Code. Specifically, the City Code defines a shopping center as: <br />"A group of four (4) or more contiguous units combined in a single, <br />architecturally unified building, containing at least forty thousand (40,000) <br />square feet of commercial gross area, located on a single site, alongwith on- <br />site parlcing which is provided in direct relationship to the types and sizes of <br />the stores contained within the building. (Ord. 958, 7-23-84), (Ord.1286, 08- <br />04-2003)". <br />5.19 Plan Consistency. When reviewing applications to rezone land, the Community <br />Development Staff determines whether the anticipated use and subsequent zoning district <br />designations are consistent with the Roseville Comprehensive Plan. The Staff has <br />concluded that the proposed reuse of properiy for Target in a General Business District <br />(B-3) is consistent with a land use map designation of Business (B), rather than the <br />current Shopping Center (SC).
