City Council Regular Meeting — 09/13/04 <br />DRAFT Minutes - Page 39 <br />Maschka moved, Ihlan seconded, authorization for the creation <br />of a second Desktop Support Specialist position within the <br />Information Technology Division; and to amend the 2004 <br />Budget to reflect the increase in revenues from contributing <br />cities and expenditures for the added position. <br />Roll Call <br />Ayes: Maschka, Ihlan, Kough and Klausing. <br />Nays: None. <br />13. Consider Asking the City Prosecutor to Issue a Ramsey <br />County Court Complaint for a Public Nuisance Code <br />Violation at 3099 Evelyn Street <br />Community Development Director Dennis Welsch reviewed the <br />history for City policy outlining staff's request of City Council <br />approval in issuing Ramsey County Court citations. Mr. Welsch <br />provided a brief history of the property and code violations at <br />3099 Evelyn Street, noting it had been an ongoing case since <br />1999, consuming considerable staff time. Mr. Welsch noted that <br />the property was currently being offered for sale, and staff was <br />requesting this action to ensure that a11 parties involved, as well <br />as potential buyers, were aware of the outstanding code <br />violation. <br />Maschka moved, Klausing seconded, directing the staff to work <br />with the City Prosecuting Attorney to pursue a Ramsey County <br />citation to cite the owner of property at 3099 Evelyn Street for <br />violation of the City Code. <br />City Manager Beets noted that the Coldwell Banker <br />RealtorBroker for the property had been in attendance at <br />tonight's meeting earlier, but prior to leaving the meeting, due to <br />the lateness of the hour, had requested to be heard by the City's <br />Prosecutor. Councilmember concurred with this request, and so <br />directed City Manager Beets to comply with the request. <br />Discussion ensued as to current City policy dictating City <br />Council approval prior to staff seeking citations through the <br />Ramsey County Court system, with Council consensus that this <br />policy be reviewed. <br />Referral of Public <br />Nuisance Code <br />Violation <br />3099 Evelyn Street <br />to City Prosecutor <br />to Issue a Ramsey <br />County Court <br />Complaint <br />
