Mayor Klausing responded to Mr. Neprash regarding the rationale for not using the Request for Proposals (RFP) process, as the City did not have control of the site, but the site was owned by private developers. Mayor Klausing reviewed the history of the Exclusive Negotiations Agreement currently in force through March of 2005 with the Master Developer, Rottlund Homes, to determine whether or not a project if feasible and beneficial to the City. Mr. Neprash also noted the previous discussions regarding the site's pollution, and recommended that the City not commit to the project until the solution is evident. Mr. Neprash questioned whether the City had sought the source of the pollution and responsible parties for remediation. Mr. Casserly reiterated past comments regarding the attempts to identify responsible parties and whether they were able to provide funds for clean up. Mr. Casserly assured residents that the identification of the sources and responsible parties was ongoing. Discussion ensued regarding the use of Hazardous Substance Sub-districts; legalities involved; continuing use versus new modified use ramifications; Ml'CA's mandates for clean up of contamination; recycling and redevelopment of contaminated land; and motivation of sellers related to clean up. H. Dick Houck, 1131 Roselawn Mr. Houck opined that the lack of public comment on this proposed development to-date was not in keeping with past City practice and policy. Mr. Houck further opined that the project appeared to be a vague concept that was requiring a lot of public money, and further questioned the process being followed by the City Council to-date.
