City Council Study Session — 09/20/04 <br />DRAFT Minutes - Page 15 <br />questioned whey the City seemed to be taking such a pro- <br />active position with this development, proposing to use <br />public funds, and how they could justify that use, and <br />recommended that the developer and Council provide a <br />more defined project if the land use proposal moves <br />forward to allow more educated public comment. <br />Mr. Houck quoted a recent newspaper article regarding the <br />zoning of the property, and opined that the process <br />indicated the City's and developer's alleged dishonesty and <br />deceitfulness from the proposed intent of Economic <br />Development laws in the State of Minnesota. <br />Mr. Houck concluded by asking the City Council to step <br />back from their pro-activity in this matter, and let the <br />development proceed as other private developments in the <br />City have done in the past. <br />Mayor Klausing responded to Mr. Houck's concerns, and <br />concurred that the Council did not usually provide for <br />formal public comment prior to the Planning Commission <br />process, but noted the unique and substantial size and <br />impact of the proposed development, and some members of <br />the Council being concerned that the public be involved in <br />all considerations from the beginning of consideration of <br />the proj ect. <br />L Terry Moses, 1776 Maple Lane <br />Mr. Moses clarified that if TIF' were used, local, county and <br />school district taxes would be impacted. <br />Mr. Moses asked that the Council and developer provide <br />more openness and honesty regarding the process; and <br />questioned the assumptions and descriptions provided by <br />Mr. Casserly. <br />Mr. Moses opined that the value of property would <br />continue to increase without use of TIF', making TIF' <br />unnecessary. Mr. Moses took issue with Mayor Klausing's <br />interpretation that the Council didn't have control of the <br />development site, opining that the City had de-facto control <br />
