Roseville City Council Page 2 of 3 III. Auction On August 25�, I spoke with the City Attorney about auctioning off this Fire Pumper on E-Bay, an on-line, popular, international auction site. The City At- torney said that such an auction was a legal way to obtain the best purchase price for this vehicle. We needed to avoid allowing city officers to bid on the ve- hicle, but otherwise such a sale was lawful. On September 3rd, I informed the Council of our plans to auction the Pumper on E-Bay. Here is what I said (thecomplete City Manager Report is attached): . The Fire Department is seeking bids from any member of the pub- lic to purchase a 1949 fire truck. This vehicle was taken out of service many many years ago, has been in inadequate make-shift storage for the last few years, and needs mechanical work. In addi- tion to a published legal notice regarding the bidding process, we are sending individual notice to each retired firefighter informing them of this opportunity to acquire, care for, and store this old piece of fire apparatus. On September 7� we published in the Roseville Review, the newspaper desig- nated by the City Council for legal notices, a notice of intent to auction this ve- hicle on E-Bay. Here is that Legal Notice: City of Roseville NOTICE OF SALE The City of Roseville will be advertising for the acceptance of bids for the sale of a 1949 Ward LaFrance fire engine. The vehicle is being sold "as-is" and it will be the responsi- bility of the purchaser to remove the vehicle from city prop- erty within 48 hours of completion of the sale. Certain appointed off'icers of the City of Roseville, such as the City Manager and department heads are not permitted (by state statute) to purchase this vehicle. If you are in doubt about your eligibility, please contact Assistant Fire Chief Tim O'Neill at 651-792-7305. The sale will take place on E-bay (www.ebay.com) starting on or about September 10, 2004.
