REQUEST FOR COUNCIL ACTION Date: 4/24/00 <br />Item No.: J-1 <br />DepartmentApprovaL• Manager Approval: Agenda Section: <br />�'� Ordinances and Resolutions <br />Item Description: Second Reading of Proposed Changes in Roseville Liquor License Requirements. <br />BACKGROUND <br />The proposed changes were discussed at the 3/27/00 regular Council Meeting. They were; 1) <br />mandatory responsible beverage service training with licensee fine forgiveness for the first <br />violation, 2) receipt requirements for home delivery, 3) keg registration and 4) increased fines for <br />the licensee and individual seller. <br />Keg registration has been removed from the proposed changes. <br />Currently, there are no violation options by a licensee for the first offense. They must pay a fine. A <br />rather small fine compared to neighboring cities. Burnsville suspends for three days for the first <br />offense, Plymouth imposes a$500 fine and a five day suspension for the first offense, Woodbury <br />imposes a warning letter for the first offense, a$2,000 fine for the second offense. Falcon Heights, <br />Little Canada, New Brighton, N. St. Paul, Shoreview and Vadnais Heights use the state statute for a <br />first offense - up to a 60 day suspension and/or up to a$2000 fine. The Council indicated a desire <br />to substantially raise the fine for the license holder and individual sellers with a differential for off- <br />sale sellers who do not earn tips to augment their salary. <br />The attached Council Resolution relating to the administrative fine structure raises the individual <br />seller fine from $100 to $250 for an on-sale employee and $150 for an off-sale employee. The fine <br />for the first violation for a license holder is raised from $150 to $700. <br />Licensee holders have stated they try their best to comply with the laws regarding legal sales, but <br />they say they are penalized for their employee actions. Licensee holders are responsible for their <br />employee's actions. This ordinance change allows two violations before a suspension is imposed. <br />That is an incentive. Responsible beverage service training is something that should be done on a <br />routine basis, if for no other reason than to reduce the licensee holder's civil liability. This ordinance <br />supports such training and gives financial incentives to supply such training. <br />As noted in prior council presentations, our compliance checks are improving. We have not had <br />100% compliance yet. That is not an unreasonable goal. The proposed ordinance changes are an <br />effort to build on that success and assist responsible license holders. <br />
