BWSR Meeting Minutes <br />October 29, 1998 <br />Page Six <br />** <br />98-71 <br /> <br />98-72 <br />NASCA Meeting Update -Jim Birkholz reported that Minnesota hosted the NACD <br />North Central Region NASCA meeting last week in Rochester. Approximately 50 <br />people attended from six states. Jim stated that it this was an opportunity for an active <br />meeting process, hope for many good benefits, good partnering. <br />New Business <br />Dispute Resolution Committee Joubert vs. Helena Township, WCA Appeal -Chair <br />Roer introduced Dave Iverson, attorney representing Joubert's; and Mark Covin, <br />attorney for Helena Township. Jim Haertel explained the appeal. Discussion followed. <br />Ron Harnack stated that BWSR has the authority to affirm or not affirm the decision of <br />the local unit of government. Ron stated that the DNR has the direct authority of <br />restoring the wetland. Chair Roer stated that BWSR can affirm the township decision, <br />but hold in abeyance, give 90 days for restoration to occur, then go to DNR for <br />appropriate legal enforcement. Rod Sando suggested that BWSR proceed with 60 <br />days and DNR will oversee restoration. Moved by Rod Sando, seconded by Barb <br />Cobb, that BWSR affirm the township decision, on both resolutions, #264a and #264b. <br />Motion passed on a voice vote. Rod will direct DNR staff to assist in negotiation. Need <br />to amend order and memorandum to affirm both resolutions. <br />1999 Natural Resources Block Grants (NRBG) -Wayne Zellmer explained that the <br />NRBG provides assistance to local governments to implement state natural resource <br />programs. In previous years these programs have been the Comprehensive Local <br />Water Planning, the Wetland Conservation Ac#, DNR Shoreland Management, and the <br />MPCA Feedlot Permit Program. For 1999, the MPCA Individual Sewage Treatment <br />Systems (ISTS) Program will be added. The NRBG is a composite base grant <br />generally formulated to reflect need/activity of these programs in all counties. This <br />grant is not competitive and all counties are eligible to apply. A county may apply for <br />any or all of the five grant program components. Moved by Allan Oehlke, seconded by <br />Dwain Otte, to authorize BWSR staff to allocate these grants to counties meeting the <br />NRBG program requirements. Motion passed on a voice vote. <br />Minnesota Wetlands Conservation Plan Memorandum of Agreement -Elizabeth <br />Carlson reported that the Conservation Plan has been completed and signed by DNR, <br />MNDOT, PCA, AG, and BWSR. She explained the phases of the plan and summarized <br />the features of the Minnesota Wetlands Conservation Plan. Ron thanked Beth for her <br />efforts in finalizing the plan and memorandum of agreement. Rod Massey also thanked <br />her for her persistence on this project. <br />
