BWSR Meeting Minutes <br />July 28, 1999 <br />Page Four <br />Jim gave an update on the Kottschade appeal. BWSR won on all counts! The <br />appellate court gives deference to BWSR's decision and not that of the city, the BWSR <br />TEP member has standing to appeal and in such circumstances no filing fee is <br />necessary, the petition doesn't have to have a lengthy description of the basis of the <br />appeal, there is no due process problems with having the matter heard only by the DRC <br />instead of the whole Board, and a detailed site plan with alternatives is needed to meet <br />sequencing requirements. And the decision was published (as opposed to <br />unpublished), which means it is precedential and binding. Glenn Annexstad stated that <br />the outcome of this appeal shows that WCA is working. <br />Education and Public Relations Committee -Paul Krabbenhoft reported that the <br />committee met this morning and discussed looking at distribution of drainage law <br />information, continuation and consistency. The committee will meet again in August. <br />Cost-Share/Soil Conservation Committee -Dwain Otte reported that the cost-share ad <br />hoc committee has not yet met, awaiting final representation by MASWCD. Dwain <br />reported that Greg Larson will make a presentation to the full board next month on the <br />history of the Cost-Share Program. <br />Wetlands Committee -Darrell Bruggman announced that the July 14 meeting was <br />canceled due io ~epreser~taiive V~,`i(iaru P~1~inger's fi.irieral. T#~e ~t7eeiitlg i~as been <br />rescheduled for Tuesday, August 3. <br />Vice-Chair Dahlvang called for a break in the meeting at 10:10 a.m. The meeting <br />reconvened at 10:25 a.m. <br />Agency Reports <br />Jim Anderson, Minnesota Extension Service, distributed a brochure on the "1999 <br />Agricultural Drainage Workshop and Field Day" scheduled for August 10-12, 1999 in <br />Owatonna, he invited everyone to attend. <br />Bob Patten, Department of Agriculture, reported on various ongoing activities at the <br />Department of Agriculture. A conference is being held on production and manure <br />contracts; he's been involved in an LCMR funded project on Land Preservation <br />Programs. Bob will supply a copy to all board members. He invited board members to <br />attend a presentation of the report on August 6 at the Department of Agriculture. The <br />Feedlot Manure and Management Committee will meet on August 16 to discuss <br />permitting and local authority and delegation. <br />
