BWSR Meeting Minutes <br />September 26, 2001 <br />Page Seven <br />** <br />01-71 <br />Shell Rock. River Watershed District Establishment Petition -Jim Haertel reported that <br />there was a typographical error in the draft Order that has been corrected. Jim stated <br />that in July 2000, the Board authorized the executive director to enter into cone-year <br />agreement with Freeborn County, Freeborn SWCD and the City of Albert Lea to hold <br />the decision in abeyance on the establishment petition for the Shell Rock River <br />Watershed District. Jim stated that staff recommends the Board enter into an <br />agreement with Freeborn County to continue the establishment petition. being held in <br />abeyance for one year and four months, per the draft Order and agreement. Harley <br />Miller, resident of Freeborn County, spoke on behalf of the petitioners. Mike Klukow, <br />spoke on behalf of Freeborn County. Discussion followed. Chair Coe said it's <br />imperative that wounds be healed; everyone involved needs to make things happen to <br />resolve the conflict and move fonrvard. The Chair of the Freeborn County Board stated <br />that they are in agreement and willing to move forward on this project. Chair Coe <br />thanked both groups far providing information today, they now need to work as a team. <br />Discussion followed regarding the dates on the signed agreement. Jerome Deal stated <br />that the internal friction needs to be eliminated. Moved by Char Kahler, seconded by <br />Ginny Imholte, to change item "B" on the Agreement from January 1, 2002, to October <br />1, 2001; to change "C" from August 1, 2.002 to June 1, 2002; to change "D" from <br />February 1, 2003 to August 1, 2002; and to change "E" from February 1, 2003, to <br />August 1, 2002. Motion was defeated.. Discussion followed. Moved by Dwain Otte, <br />seconded by Jim Anderson, to approve the signed Agreement and approve the Order <br />as recommended by staff, that the proceedings on the Establishment Petition for the <br />Shell Rock River Watershed District be held in abeyance up to February 1, 2002, <br />subject to the successful .and timely completion of the conditions listed in the <br />Agreement and made a part of the Order. Motion passed on a voice vote. Ginny <br />Imholte opposed the motion. Chair Coe stated that timelines are important, as well as a <br />team effort to move this forward. Chair Coe thanked the Freeborn County delegation <br />and Harley Miller, on behalf of the petitioners, for presenting their information. <br />Low Phosphorus Lawn Fertilizer -Woody Love, Mayor of Shorewood, distributed <br />"Better Water Quality with. Proper Lawn Fertilizers", draft language for a legislative bill, a <br />sample resolution. He also presented additional information on phosphorus. Mike <br />McGreevy, attorney for Larkin, Hoffman, and lobbyist working with Woody on this <br />legislative initiative that provides for limitations in the use and sale of phosphorus lawn <br />fertilizers; requiring rule making; appropriating money; and amending Statutes. <br />Discussion followed. Sharon Clark commends Woody and Mike for their efforts. <br />Sharon stated that MDA is willing to work with them on the legislative initiative. Chair <br />Coe appreciated the information provided. Chair Coe asked for updates and revisions <br />as this initiative moves forward. <br />g <br />
