Permit 02-12; Wal~reen's - St. Paul <br />The Hardees site at the intersection of White Bear Avenue and Old Hudson Road is being redeveloped, <br />which is upstream of Suburban Pond. The Board asked for clarification on the special provisions as <br />recommended by staff. The applicant proposes to install a specific manufacturer's stormwater treatment <br />system, and Special Provision #1 requires staff review of the details before issuing the permit. Regarding <br />Special Provision #2, the Board wants the maintenance agreement for the treatment system to address <br />periodic inspection intervals and reporting requirements. <br />Motion: Paul Ellefson moved, Bob Johnson seconded, to approve Permit #02-12. Motion carried. <br />Permit 02-13• Carriage Homes of Maple Hills -Maplewood <br />This project is a redevelopment of the Maple Hills Golf Course. District staff recommends acceptance of <br />the wetland mitigation plan that proposes to fill 4,470 square feet of degraded wetland, create 5,200 square <br />feet of new wetland, and create 3,900 square feet of wetland buffer. Cliff Aichinger pointed out the water <br />level of the land-locked pond needs to be monitored over time. Since there is no outlet, and staff does not <br />want the drainage to reach Phalen Lake. <br />Motion: Jack Frost moved, Paul Ellefson seconded, to approve Permit #02-13 and the associated <br />mitigation plan. Motion carried. <br />Permit 02-15; Beaver Lake Townhomes -Maplewood <br />The applicant proposes to fill two incidentally-created wetlands on the site, and staff recommends granting <br />wetland exemptions for these two wetlands. <br />Motion: Bob Johnson moved, Roger Lake seconded, to approve Permit #02-15 and the associated wetland <br />fill exemption. Motion carried. <br />Permit 02-16; Phalen. Wetland Restoration Phase 3 - St. Paul <br />The City of St. Paul, as local governing unit for WCA, has issued a Certificate of No Loss for the degraded <br />wetland that will be excavated. <br />Motion: Jack Frost moved, Roger Lake seconded, to approve Permit #02-16. Motion carried. <br />Permit 02-17; Kline Nissan -Maplewood <br />The applicant is requesting a variance from the District's 75-foot no-disturb buffer requirement in order to <br />remove all of the buffer, install an infiltration system, and then restore a restore a 25-foot buffer over the <br />infiltration system with native plantings. Pam Skinner cited the District's policy that establishes minimum <br />wetland buffer setbacks for land disturbance activities adjacent to Protect category wetlands. Cliff noted <br />that considerable construction rubble is visible along the edge of this wetland. The edges contain mostly <br />reed canary grass and cattails, but the quality improves further into the wetland. <br />Karl Hammers stated that the applicant cannot maintain a minimum 10-foot buffer using the current plans. <br />The newer type of monofilament silt fence as specified in Special Provision #4 will do a good job to <br />contain any sediment, and the site is very flat, which reduces risk of wetland impact. Rob Langer stated <br />that the biggest threat to the wetland would come from a high creek elevation, and he also feels that good <br />erosion control could be maintained through proper construction sequencing. <br />Motion: Jack Frost moved, Paul Ellefson seconded, to approve Permit #02-17 as amended: to grant a <br />variance to Special Provision #2 which allows a zero buffer setback, during construction, requiring the <br />applicant to take extra. precautions near the wetland through implementation. of construction sequencing to <br />minimize erosion, and to require the applicant to immediately restore areas of damaged silt fence. The <br />motion carried with 4 ayes (Frost, Ellefson, Johnson, and Lake) and 1 nay (Skinner}. <br />Permit 02-18: County Road DReconstruction -Maplewood <br />Motion: Bob Johnson moved, Paul Ellefson seconded, to approve Permit #01-18.
