A site visit was made to verify the classification.. <br />Staff determined that the Protect wetland classification was not appropriate. Instead, a Manage 2 category <br />was determined by staff to be the appropriate classification, with an associated 25-foot buffer requirement. <br />The applicant has requested a variance to allow a 15-foot buffer. It was agreed that site restrictions <br />presented a significant hardship due to existing roadways and setback requirements. <br />Motion: Jack Frost moved, Paul Ellefson seconded, to approve Permit #02-38 and the associated wetland <br />buffer variance. Motion carried. <br />Permit 02-39; Wyndham Ponds, Phase I -Woodburv <br />This development contains 114 single-family homes and 197 townhomes. Two of the six wetlands onsite <br />are exempt from WCA requirements. Proposed wetland impacts include: 730 square feet to build a berm, <br />and 2,418 square feet to construct a roadway. Sequencing arguments and the mitigation plan have been <br />submitted, and all mitigation is proposed to be on-site at a 2:1 ratio. <br />Tina distributed Hedlund Engineering's memo dated 8/5/02, which explains their request for a variance <br />from the 50-foot buffer requirement on a Manage 1 wetland in order to accommodate a trail system on the <br />northerly, easterly, and southwesterly edges. This basin will be used for stormwater treatment and will also <br />alleviate flooding problems associated with the adjacent Villa Piazzre development (Permit #01-34). <br />Motion: Paul Ellefson moved., Bob Johnson seconded, to approve Permit #02-39 and the associated <br />wetland exemption and wetland buffer variance. Motion carried. <br />Permit 02-40; New Life Academy High School - WoodburX <br />In order to receive this permit, the applicant must also comply with the terms of an earlier WCA Wetland <br />Replacement Plan that requires the submission of a monitoring report for the wetland that was created as <br />part of Permit #96-27. <br />Motion: Roger Lake moved, Paul Ellefson seconded, to approve Permit #02-40 and the associated WCA <br />reporting requirements related to the site. Motion carried. <br />Permit 02-41: Snyder Drug, Market Place -Little Canada <br />Stormwater will be treated in a new stormwater pond to be completed as part of the City of Little Canada's <br />2002 street improvements project (Permit #02-26). This pond will treat the water from this site before it <br />enters Round Lake. <br />Motion: Paul Ellefson moved, Bob Johnson seconded, to approve Permit #02-41. Motion carried. <br />Permit 02-42; Battle Creek Lake Area Flood Protection -Woodburv <br />The District's CIB project will create a 450-foot long berm above the ordinary high water level of the lake <br />to protect two remaining homes that were not purchased by the City of Woodbury. <br />Motion: Roger Lake moved, Bob Johnson seconded, to approve Permit #02-42.
