<br />Monthly Enforcement Report <br />No violation notices were. issued during January <br />Ongoing enforcement issate--damaged wetland at Tartan High. School (Permit #02-09}: According to the <br />conference call that Tracey Galowitz initiated with Kraus Anderson and Kellington Construction, the erosion <br />control blanket was apparently laid in January without advance notice to the District. The restoration work can <br />start once the frost is out of the ground. Tracey will send them a letter outlining what needs to be done at that <br />time, with a deadline stipulated. <br />Roger called for discussion of Entry #5814 from this month's Correspondence Log. There was concern <br />among Board members that there may have been a lack of response to the organization's earlier <br />correspondence sent to the District office in November and December. The Willow Marsh Coach Homes <br />Association of White Bear Lake has requested assistance from the Board of Managers to address elevation, <br />design., and capacity concerns related to high water levels in the stormwater pond that impacted the residents <br />of 1747 - 1755 Elm Street following two summer 2002 storm events (Permit #97-30). Cliff reported that the <br />pond was actually designed to serve as stormwater detention for the commercial and industrial sites that are <br />also part of this development, located south and east of the intersection of Highway 61 and County Road E. <br />He stated that it is not the District's responsibility to correct the problem but he proposed to draft a letter of <br />response, recommending that the organization work with the city and developer to correct the situation. The <br />letter will also direct them to collect information on the following key issues: <br />® Excess water should be flowing to the overflow Swale <br />• Check actual elevations of the pond outlet and the first floor level of the units <br />a Check swale construction for proper shape, check pipe outlet size, and check for clogs <br />5. PROJECT STATUS REPORTS <br />CIP Maintenance/Repairs 2003 ProLt <br />The Notice to Proceed is expected to be issued to Holst Excavating during the first week of February once <br />staff completes their review of the required submittals. <br />Project 3 -West Tamarack Swamp Improvements <br />Battle Creek Lake Flood Protection Project: It was reported that District staff met with Jay Brothers on <br />January 13 to discuss the remaining punch list items and the delays associated with this project. Tonight's <br />discussion on liquidated damages was postponed until Brad Lindaman's arrival. <br />Motion: Paul Ellefson moved, Roger Lake seconded, to approve Change Order #1 to the Battle Creek Lake <br />Flood Protection Project, which represents a $1,710.00 increase in the contract price to furnish and install <br />insulation for the Lift Station structure. Motion carried. <br />Carver Subwatershed Infiltration Study <br />Cliff stated that the draft report will be sent to Board members in advance of the March meeting date. <br />Tanners Alum System Water Ouality Monitoring and Permit Renewal Process <br />Discussion was held on the January 30 meeting between District staff and MPCA to discuss permitstandards <br />and system performance. Currently, the facility meets the standard for dissolved aluminum but it does not <br />meet the standard for total aluminum. The District's report on the entire five-year permit period should be <br />ready for distribution in May. <br />Pam Skinner asked if there is a concern that total (background) aluminum levels do not meet the standard. <br />Cliff stated that aluminum is anaturally-occurring characteristic of the soils in the region, which affects the <br />total aluminum levels reported. He also pointed out that alum treatment is a new technology, and MPCA had <br />used EPA's guidelines in order to set the standards at the time the District's permit was issued. District staff <br />have questioned whether it is necessary for MPCA to set a standard for total aluminum. MPCA will consider <br />the need to continue with a total aluminum standard but first, they-want to review the facility operation results <br />over the first five years of the permit as contained in the District's final. report. <br />The MnDNR will also be making a state wetland jurisdiction determination on the 7`~' Street Wetland, which <br />may improve permit compliance if it is considered to be part of the overall treatment system. <br />Tanners Lake Flood roofing Project <br />In an effort to limit costs, Cliff recommended. that the District first try to sell the Rabine property by <br />advertising for sealed bids.
