citizen) of the City. What type of impact will these people feel when their 20,000
vehicles see the picture below as they pass by?
Just the fence material used in community gardens would violate City Code
due to being out of harmony with a residential neighborhood. Code 407.02
states: "The following are hereby declared to be public nuisances affecting health,
safety, comfort or repose...
(J) Building Maintenance and Appearance: Buildings, fences, and
other structures, which have been so poorly maintained that their
physical condition and appearance detract from the surroundine
neighborhood are declared to be public nuisances because they: 1)
are unsightly, 2) decrease adjoining landowners' and occupants
enjoyment of their property and neighborhood, and 3) adversely
affect property values and neighborhood pattern."
I find it very bizarre that the City, in light of its nearby revitalization, would allow
the church to go forward with their plans knowing full well that its activities
would be considered a public nuisance under the City Code.
Did I mention that I am not a lawyer? You see, even anon-lawyer can read
and comprehend the City Code.
I would also like to mention that I am a 43 year-old student working on my
degree in Environmental Science. Naturally, I am concerned by the impact this
garden will have on wildlife.
