the air quality indicates low emissions meeting state requirements. MnDOT reviewed necessary <br />and possible permits for right-of-way work and possible pond changes. Other reports are <br />attached. <br />5.0 STAFF RECOMMENDATIONS <br />5.1 Staff has found the proposed office use is similar to and consistent with other permitted uses in <br />the PUD. Based on the EAW and comments (with no significant impact and no request for <br />further environmental work). A negative EAW declaration and PUD land use approval should <br />be granted. <br />5.2 On March 26th, the City Council will review additional staff and Planning Commission <br />recommendations; receive the final comments on the EAW and decide on the Council's <br />declaration of EAW adequacy and impact. A"negative" declaration means the City has <br />found that there is no significant environmental impact. Assuming there are no additional <br />significant environmental impacts, the Council then may approve the concept and final <br />amendment to the Planned Unit Development documents. <br />6.0 PLANNING COMIVIISSION PREVIOUS ACTION <br />The Planning Commission after a hearing on January 10, 2001, recommended that the proposed <br />land use (business office) was consistent with the Comprehensive Plan and the Centre Pointe <br />PUD intent. They recommended that the Voluntary EAW be completed based on the proposed <br />uses. The Commission reviewed the EAW and comments at their March 14, 2001 meeting and <br />recommended approval of the EAW and PUD amendment. <br />7.0 SUGGESTED CITY COUNCII, ACTION <br />7.1 Offer a resolution, after review of the Voluntary EAW and comments, that the Council has <br />determined that there is no significant additional environmental impact requiring an <br />Environmental Impact Statement and therefore the City will issue an EAW Negative Declaration <br />regarding the Veritas EAW. (draft attached) <br />7.2 By motion, the Council finds the land uses proposed within the Veritas amendment (122,000 s.f. <br />of additional office space) to the e�sting Centre Pointe Business Park Planned Unit <br />Development to be consistent with the Comprehensive Plan and the intent of the 1997 Centre <br />Pointe PUD, and therefore the Council approves the concept, waives a first reading, and <br />approves the final PUD amendment ordinance, subject to review by the City Attorney.
