Site #NIIN544 <br />LEASE AGREEI�IENT <br />This Lease Agreement ("Lease") is entered into this day of , 2001, by <br />and between the City of Roseville, a NTinnesota municipal corporation ("Owner" or "Lesso�") <br />and Qwest Wireless, L.L.C., a Delaware limited liability company ("Qwest"), with local offices <br />at 426 North Fairview Avenue, Suite 101, St. Paul, MN 55104 ("Lessee"). <br />Recital <br />The Lessor is the owner of a certain parcel of properiy lying within the City of Roseville, <br />County of Ramsey, State of Minnesota, which is more particularly described on Exhibit "A". <br />It is the intention of the parties that the Lessee leases one particular site on the parcel and <br />construct a communications antenna tower and certain accessory buildings to the <br />communications antenna tower, which is more particularly described on E�ibit "B" ("Leased <br />Premises"). The entire constructions costs sha11 be the responsibility of the Lessee. The Lease <br />will run for ten (10) years with two (2) ten (10) year e�tensions at the option of the Lessee. <br />In consideration of the terms and conditions of this Agreement, the parties agree as <br />follows: <br />1. The Propertv. Lessor is the record owner of a certain parcel of real property located <br />in the State of Minnesota, County of Ramsey, City of Roseville, commonly known as Roseville <br />Fire Station #3 (the Properiy). A legal description of the Property is contained in E�ibit "A" to <br />this Lease. <br />2. Leased Premises. Owner hereby leases to Lessee that portion of the Property ("the <br />Leased Premises") upon which Lessee sha11 construct certain communications facilities <br />consisting of a self-supporting antenna communications tower appro�mately si�ty (60') feet in <br />height and color of which shall be in UPS brown with a Unipak antenna system at the top of said <br />tower; ground space comprising appro�mately two thousand five hundred (2,500) (50 x 50) <br />usable square feet, the exact amount to be fixed by parties and described on E�ibits "B" and <br />"C"; non-exclusive easements required to run utility lines and cables, and a non-exclusive <br />easement across Owner's Properry for access to the Leased Premises. No other space or <br />property interests are being leased to the Lessee except as described as above and as described on <br />E�ibit "B". <br />3. Tenn/Renewals. <br />8383 I <br />
